ETHICS IN MEDIATION: THE ROLE OF ADVOCATES IN DISPUTE RESOLUTION

Abstract: Mediation is an alternative method of dispute resolution that is increasingly being used in the modern legal system. This process prioritizes dialogue between the disputing parties to reach an agreement without resorting… to litigation. In mediation, ethics plays an important role in maintaining fairness, confidentiality and professionalism, both by the mediator and by the advocates involved. Advocates have a strategic role in mediation, namely as legal advisors who provide direction to their clients, and ensure that the mediation process runs in accordance with existing ethical principles. Advocates also function to maintain the integrity and confidentiality of information obtained during mediation, as well as ensuring that clients are not pressured into accepting detrimental agreements. In this paper, we discuss the importance of ethics in mediation, the challenges faced, and the vital role of advocates in ensuring fair and effective dispute resolution. By paying attention to ethics in mediation, it is hoped that the dispute resolution process can take place more transparently, efficiently and fairly for all parties involved.

The main sources for this research come from related literature, including books, scientific journals and official documents which discuss judges' codes of ethics, integrity values and accountability principles in the judicial context. used in this research consists of primary data and secondary data. The definition of a judge's code of ethics is a concrete expression of ethics, morality and religion. The judge's code of ethics is an important basis for maintaining integrity and responsibility. You must be able to face challenges and be balanced, taking full responsibility and responding to your challenges. Conscience, ethical values of society and SWT Allah SWT, and because being a judge is a profession, there is a need for a code of ethics or professional code.

Through the perspective of Islamic legal philosophy, this study explores how Islamic legal principles such as justice ('adalah), welfare (maslahah), and obedience to the law (ta'zim al-qanun) can strengthen the Indonesian legal system. This journal uses a descriptive qualitative research method with a literature review approach to understand the role of Muslims in the context of law enforcement in Indonesia. The findings show that Muslims have a significant role in fighting for the values of justice and maintaining the integrity of the legal system based on Islamic spiritual, moral, and ethical foundations.

Penelitian… ian ini bertujuan untuk menganalisis bagaimana peran etika profesi dalam mencegah penyalahgunaan wewenang di kepolisian dan kendala apa saja yang dihadapi dalam implementasi etika profesi untuk mencegah penyalahgunaan wewenang oleh anggota kepolisian. Penelitian ini termasuk dalam penelitian pustaka atau library research yaitu data penelitian sepenuhnya bertumpu pada data-data pustaka yang diperoleh dari sumber-sumber kepustakaan. Teknik pengumpulan data dilakukan dengan teknik kepustakaan dan teknik analisis data dilaksanakan dengan metode deksriptif. Adapun hasil penelitian ini: Peran etika profesi dalam mencegah penyalahgunaan wewenang di kepolisian sebagai instrumen pencegah etika profesi dalam mencegah penyalahgunaan wewenang di kepolisian. Kendala utama dalam implementasi etika profesi untuk mencegah penyalahgunaan wewenang di kepolisian di antaranya meliputi minimnya pembinaan secara berkesinambungan bagi para anggota polri, budaya kerja yang buruk yang mendukung terlaksananya penyalahgunaan wewenang, kurangnya refleksi diri, ketidakseimbangan moral dan kekuasaan serta diri yang tidak berkeinginan untuk mematuhi kode etik. Kesimpulan penelitian ini bahwa etika profesi berperan penting dalam mencegah penyalahgunaan wewenang di kepolisian dengan memberikan panduan moral dan prinsip integritas bagi anggota Polri. Penerapan sanksi tegas diharapkan menciptakan efek jera. Namun, implementasinya menghadapi kendala seperti minimnya pembinaan, budaya kerja yang buruk, kurangnya refleksi diri, serta ketidakseimbangan moral dan kekuasaan yang menghambat kepatuhan terhadap kode etik.

ANALYSIS OF DIFFERENCES IN PERCEPTIONS OF PROFESSIONAL ETHICS BETWEEN MALE AND FEMALE LEGAL PRACTITIONERS

Abstract: This study aims to analyze the differences in perceptions of professional ethics between male and female legal practitioners in Indonesia. In the legal profession, professional ethics have a very important role to maintain… in integrity and public trust. However, factors such as gender are thought to influence the way legal practitioners perceive and apply these ethical principles. The research method used is Qualitative by using a literature-based approach. The data collected is analyzed using a quantitative approach to see if there is a significant difference between the perception of professional ethics between men and women. The results showed that there are differences in perspectives on several ethical issues, where women tend to emphasize the values of social justice and diversity, while men focus more on compliance with formal regulations. This research is expected to provide deeper insights into gender dynamics in the legal world and its contribution to the development of a more inclusive and equitable legal professional ethics.

Abstract: Pendidikan Islam di Indonesia telah mengalami transformasi signifikan untuk memenuhi tuntutan masyarakat modern. Sejak pertama kali diperkenalkan di nusantara hingga saat ini, kurikulum pendidikan Islam terus berkembang… sebagai respons terhadap kebutuhan masyarakat. Namun, tantangan masih tetap ada, termasuk keterbatasan dalam metode pengajaran, integrasi nilai-nilai Islam dengan kemajuan ilmu pengetahuan, dan kesiapan sumber daya manusia. Secara historis, kurikulum ini telah melalui beberapa fase penting: masa kolonial, masa pasca kemerdekaan, dan era globalisasi. Setiap fase memperkenalkan tantangan dan kebijakan yang unik dalam pengembangan pendidikan Islam. Pemerintah Indonesia, melalui regulasi seperti Undang-Undang Sistem Pendidikan Nasional dan kurikulum berbasis kompetensi, telah berupaya mengintegrasikan pendidikan Islam ke dalam sistem pendidikan nasional. Namun, integrasi ini sering kali menimbulkan dilema antara pelestarian nilai-nilai Islam dan penerimaan terhadap ilmu pengetahuan modern. Penelitian ini menggunakan pendekatan kualitatif dengan fokus pada penelitian kepustakaan untuk mengkaji perkembangan historis, tantangan, dan solusi terkait kurikulum pendidikan Islam di Indonesia. Temuan penelitian menunjukkan adanya masalah yang terus berlangsung, seperti dikotomi antara ilmu agama dan ilmu sekuler, sentralisasi kurikulum, serta kelebihan muatan kurikulum. Penelitian ini juga menyoroti perlunya reformasi menyeluruh, pengembangan profesionalisme guru, serta integrasi pendidikan Islam dan pendidikan sekuler untuk menghasilkan lulusan yang seimbang dan kompetitif. Kurikulum yang adaptif dan responsif sangat penting untuk menjaga relevansi pendidikan Islam di tengah perubahan global yang cepat, guna memastikan bahwa generasi mendatang memiliki integritas moral yang kuat, pengetahuan agama yang solid, dan keterampilan yang beragam.

Analisis Visual Pengaruh Noise Terhadap Kualitas Sinyal Analog dan Digital Menggunakan Software Audio

Abstract: Signal interference or noise is one of the main problems in data transmission that can reduce information quality in both analog and digital systems. This study aims to visually analyze the effects of noise using audio software.… oftware. The method used is simulation-based, where a pure signal is used as an initial reference before being subjected to various levels of interference. The analysis results show that in analog signals, noise causes permanent waveform distortion that is difficult to recover. In contrast, digital signals tend to maintain data integrity as long as the interference does not exceed a certain threshold. These differences in signal characteristics can be visually observed through waveform displays in the software. The results indicate that digital systems have advantages in maintaining signal quality in noisy environments and have the potential to be used as educational media for basic telecommunication and signal processing studies.

Implementasi Peraturan Menteri Dalam Negeri Nomor 72 Tahun 2022 di Kabupaten Merauke

Abstract: This study provides an overview of the implementation of the Regulation of the Minister of Home Affairs Number 72 of 2022 in Merauke Regency. The purpose of this study is to analyze and comprehensively describe the implementation… mentation of the Regulation of the Minister of Home Affairs Number 72 of 2022 in Merauke Regency and to identify the factors inhibiting its implementation in the region. This study applies Edward C. III’s policy implementation theory and uses a qualitative research approach through in-depth interviews with 16 informants to explore their meanings, perceptions, and understandings. A semi-structured interview approach was employed to enable the researcher to obtain flexible yet focused data, as stated by Prof. Dr. Lexy J. Moleong (2014). The study utilized an interactive data analysis technique consisting of data collection, data reduction, data presentation, and conclusion drawing. The results of this study indicate that the implementation of the Digital Population Identity (IKD) policy in Merauke Regency has been carried out in accordance with directives from the central government through a tiered and continuous communication mechanism. However, its implementation has not yet been optimal at the regional level. The main obstacles include limited socialization, low understanding and acceptance of the policy among implementers, the absence of specific Standard Operating Procedures (SOPs) for IKD, and the lack of motivation, commitment, and integrity of human resources, ICT infrastructure, and budgetary support. In addition, the social, economic, cultural, and geographical conditions of the community also hinder the utilization of IKD, resulting in its limited use and the continued dominance of physical population documents. The findings of this study emphasize the need to strengthen communication aspects, resources, implementers’ commitment, and policy adjustments to local conditions in order to achieve the objectives of the IKD policy effectively and equitably.

Presepsi Masyarakat terhadap Penerapan Prinsip Good Governance di Kampung Gurinda Jaya Kabupaten Merauke

Abstract: This research is motivated by the suboptimal implementation of good governance principles in public services at the village level, which influences public perceptions of the performance of government officials. The purpose… se of this study is to analyze public perceptions of the implementation of the principles of accountability, transparency, openness, and the rule of law in public services in Gurinda Jaya Village, Merauke Regency, and to identify supporting and inhibiting factors. This study used a qualitative approach with a descriptive approach through observation, in-depth interviews, and documentation of village officials and community service users. The results indicate that the implementation of good governance principles has not been optimal, characterized by discrepancies in service delivery times with established standards, limited public understanding of service information, inconsistent transparency practices, and an unfulfilled sense of justice and legal certainty in public services. The study's conclusion confirms that strengthening apparatus capacity, improving discipline and integrity, and strengthening village government commitment and community participation are important implications for realizing more effective and accountable village governance.

Abstract: This study is grounded in the crisis of leadership integrity within Christian education, characterized by inconsistency between teaching and the lived practice of Christian Religious Education teachers, which consequently… y weakens the formation of students’ character. The research problem addresses how Moses’ leadership integrity in Numbers 12:3–8 is understood through exegetical analysis and how it is relevant to the leadership of contemporary Christian Religious Education teachers. This study aims to identify the principles of Moses’ leadership integrity and to formulate its theological and practical relevance for Christian education. The research employs a descriptive qualitative method through biblical exegesis, theological analysis, and practical theology based on library research. The findings indicate that Moses’ integrity is grounded in profound humility, an intimate relationship with God as the source of leadership legitimacy, and moral consistency in obedience to the divine calling despite criticism and internal conflict. The study concludes that leadership integrity is not based on formal position, but on character quality aligned with the will of God and a living spiritual relationship. Its implication for Christian Religious Education teachers is that integrity constitutes the foundation of pedagogical and spiritual authority in shaping students’ character through life example, alignment between faith and action, and deep spiritual devotion. The novelty of this research lies in integrating the exegetical study of Numbers 12:3–8 with the construction of a leadership model for Christian Religious Education teachers based on three core dimensions of Moses’ integrity, forming a coherent theological framework applicable to contemporary Christian education.
