LEGAL REVIEW OF THE VALIDITY OF BACK-DATED AGREEMENTS ACCORDING TO AGREEMENT LAW IN INDONESIA

Binaku
Abstract: The legal basis of a valid contract according to the Civil Code is regulated in Article 1338 of the Civil Code, namely that all formal contracts apply as law for the parties thereto. From this article it can be concluded… that there is a principle of freedom of contract, but this freedom is limited by the law of coercion, so that the contracting parties must submit to the law of coercion. The legal consequences of a previous contract for the parties to the contract can be terminated by one of the parties who submits a request for cancellation, a demand for a refund or even a claim for compensation if misstatements and errors are found in the contract and the backdated date. The validity and date of withdrawal of physical evidence of the contract, it is necessary to first examine the conditions for the validity of the contract, which must meet the prerequisites ( agreement of the parties), although Article 1321 of the Civil Code emphasizes the validity of the contract itself, which must not be the result of error, coercion or fraud.

LEGAL REVIEW OF MARRIAGE AGREEMENTS MADE POST-MARRIAGE AFTER THE APPROVAL OF MK DECISION NO. 69/PUU XIII / 2015 (Analysis of Determination Number 80/Pdt.P/2020/PN.Ptk)

Jaka
Abstract: The legal provisions governing the marriage contract according to the Republic of Indonesia Law No. 1 of 1974 and the Constitutional Court Decision No. 69/PUU-XIII/2015 can be carried out after marriage, because the meaning… ing of Article 29 paragraph (1) of the Marriage Law is interpreted as long as the parties are bound. The agreement of both parties can submit a written agreement that is accepted by the contract drafter or notary. The Judge's opinion that the relevant application is stated in the Applicant's Marriage Agreement and the legal issues are also acceptable. The legal analysis of the permissibility of the marriage contract arises from the perspective of the law of the contract that the legal provisions of the marriage contract also bind third parties, so that the marriage contract must be registered with the Civil Service Secretariat or the Ministry of Religion. Because the MK decision as it is does not mean anything about registration, whether registration must be carried out immediately or wait for further registration/registration laws. Therefore, the legal consequences of a marriage contract can create legal guarantees for others.

Cluster random sampling was used to collect samples, with X MIPA1 and X MIPA2 acting as the experimental and control groups, respectively, with a total of 32 participants each and a teaching model that emphasizes in-depth learning with short lessons. The instrument used in this study was an essay test with approximately 10 validated topics. Data analysis of Lhitung-Ltabel and Fhitung-Ftabel showed that both data sets had a normal and homogeneous distribution. Analysis of two similar government agencies will be carried out next. The results of both classes were normally and uniformly distributed. Because tcount > ttable, the results of the one-tailed t-test for alpha = 0.05 and dk 62 produced tcount = 21.27 and ttable 1.99. This shows that there are significant benefits from using interdisciplinary learning with an inquiry model to support the student process in semester X of Mathematics and Natural Sciences in the academic year 2022/2023.

These figures are based entirely on research findings. The suggested pretest ratings and desired deviations for the manipulation style were 35.44 and 3.82, respectively , and the intended posttest ratings were 71.33 and 5.93. Lcount Ltable was accepted for each instruction with a daily distribution, even as Fcount obtained Ftable for homogeneous elegance. The results of the statistical test (t-party test ) and dk 56 found that the initial abilities of the 2 lessons were the same because tcount < ttable, or -0.84 1.94, is true. Furthermore, exclusive treatment has been applied to 2 lessons and towards the end of the lesson a publication test was given. From the results of the statistical test of the fact (one-celebration t check) it was obtained tcount > ttable, namely 2.41 > 1.94, this indicates that there is a possibility of a Jigsaw type cooperative learning model that has a large influence with the help of PhET on student learning outcomes. resulting in excessive magnificence of Gajah Mada's personal XI questions, faculty of 2022/2023 academic year .

ANALYSIS OF MARRIAGE LAW THROUGH MOBILE TELEPHONE COMMUNICATION DEVICES FROM THE PERSPECTIVE OF ISLAMIC LAW

Tatang
Abstract: Marriage from an Islamic legal perspective through mobile phone communication is a new issue, as there is no standard fiqh book on this matter. The validity of marriage through telecommunications does not yet have its own… n legal status because the Marriage Law 1 of 1974 does not regulate the law of prenuptial agreements. Legal analysis of the Islamic legal concept of marriage through telecommunications requires a search for law ( rechtsvinding ) by judges as conservative parties. Even in lawless environments, there are attempts to violate or break well-enforced rules and regulations. Efforts to interpret existing law properly can be applied in all future cases, because the law is sometimes unclear, incomplete, or not up-to-date ( rechtsvinding ). In other words, judges must adapt the law to more serious cases, because existing law cannot cover all social phenomena.
