APPLICATION FOR DETERMINATION OF HEIR CONTENTS AT BANDA ACEH SYAR’IYAH COURT

Rian Apriesta Ramsadefa, Ilyas Yunus, Zahratul Idami
Abstract: To determine the rightful heirs must be determined in court voluntarily as regulated in Article 49 Letter b of Law Number 3 of 2006 concerning the Authority of Religious Courts. However, in reality there are heirs who are… e unwilling to submit an application for the determination of heirs, resulting in the obstruction of the rights of other heirs. The purpose of writing this thesis is to explain the procedures and special requirements in submitting a contentious determination of heirs, to explain the evidence of the applicants against the heirs, and to explain the efforts made to overcome obstacles in determining heirs contentiously. This research is an empirical legal research, data is obtained directly through interviews and literature reviews. Data is collected and then analyzed qualitatively. The results of this study indicate that there are still many heirs who submit the determination of heirs voluntarily with a lack of parties and result in their decisions being declared unacceptable, but in terms of contention there are still many heirs, judges and lawyers who do not know that there are provisions in the Circular of the Supreme Court (SEMA) Number 5 of 2021- Formulation of the Law of the Religious Chamber-2.b there are special procedures and requirements and proof in the submission as well as obstacles and efforts that must be made in the application for determination of heirs contentiously which is different from voluntary. It is recommended that the Sharia Court provide information regarding the new provisions in submitting applications to both lawyers and interested parties in order to obtain legal certainty because many parties do not yet know these provisions.

Abstract: The Fifth Industrial Revolution (Industry 5.0) presents both challenges and opportunities for global economic development, where advanced technologies such as Artificial Intelligence (AI), big data, and the Internet of Things… hings (IoT) are transforming industries and societies. The main challenges include the lack of human capital preparedness to quickly adapt to technological advancements and the low level of environmental awareness in many industrial sectors. Economic growth that focuses excessively on natural resource exploitation exacerbates environmental degradation and climate change. Therefore, collaboration between human resources, technology, and environmental consciousness is essential to achieving sustainable and inclusive development. This study aims to identify gaps in human resource readiness, technological utilization, and environmental awareness and to propose economic development strategies for the industry 5.0 era that address these challenges. The research method employed is a literature review, analyzing various academic papers, reports, and secondary data from scientific journals, government reports, and industry-related articles. The findings show that technology serves as a primary driver of innovation, but human-technology collaboration is crucial for creating sustainable value. Additionally, the rising environmental awareness offers opportunities for industries to shift towards more eco-friendly business models, such as the circular economy and renewable energy. Collaboration between governments, the private sector, academia, and civil society is needed to realize inclusive and sustainable development in this era.

Legal Certainty for Creditors Due to Legal Efforts to Postpone Debtors' Debt Payment Obligations

Sodikin, Sodikin, Roosdiana Harahap
Abstract: The Suspension of Debt Payment Obligations (PKPU) is a legal procedure that allows debtors who are unable, or expect to be unable, to continue paying their due and collectible debts to seek legal recourse. Debtors in such… h situations can initiate legal action during the PKPU process. However, the question arises: what is the legal certainty for creditors following the Constitutional Court's decision that encourages debtors to pursue legal action? This study uses a descriptive normative research method to analyze the legal issues related to such actions. The findings indicate that the legal recourse available to debtors in specific circumstances significantly impacts creditors. This leads to uncertainties regarding payment, especially if the debtor decides to file for legal action. Additionally, these uncertainties can affect the creditor's business operations. The Constitutional Court's decision, subsequently reinforced by a Circular Letter from the Supreme Court, does not adequately address the gaps in legal certainty faced by creditors. This situation complicates creditors' efforts to secure their rights, which are the obligations of the debtor.
