INTERFAITH MARRIAGE IN ISLAMIC FAMILY LAW: THE PERSPECTIVE OF CLASSICAL FIQH AND THE COMPILATION OF ISLAMIC LAW

Nurmalinda, Sri, Firmansyah, Heri
Abstract: Interfaith marriage is a classic yet ever-relevant issue in Islamic family law. This study aims to examine the legal status of interfaith marriage in Islamic family law through classical and contemporary fiqh perspectives,… s, as well as its arrangement in the Compilation of Islamic Law (KHI) in Indonesia. The method used is normative legal research with statutory and conceptual approaches, referring to authoritative classical tafsir and fiqh works such as Jami' al-Bayan by al-Tabari, al-Jami' li Ahkam al-Qur'an by al-Qurtubi, Tafsir Ibn Kathir, al-Umm by Imam al-Shafi'i, and al-Mughni by Ibn Qudamah, as well as contemporary works such as Fiqh al-Sunnah by Sayyid Sabiq and the works of Wahbah al-Zuhaili and Yusuf al-Qaradawi. The findings indicate that classical jurists unanimously prohibit the marriage of a Muslim woman to a non-Muslim man and the marriage of a Muslim man to a polytheist (mushrik) woman, but differ regarding the marriage of a Muslim man to a woman of the People of the Book (Ahl al-Kitab). Meanwhile, the KHI takes a stricter stance by prohibiting all forms of interfaith marriage, in line with the principle of preventing harm (sadd al-dhari'ah) and the MUI Fatwa of 2005. This study concludes that the KHI represents a contextualization of fiqh adapted to the conditions of Indonesian society.

The research method used is qualitative with a descriptive-analytical approach, through literature review and normative analysis of traditional practices. This tradition also functions as an instrument of social legitimacy in Sipirok traditional marriage. Thus, mengumpar ruji has a strategic role in maintaining social harmony and the sustainability of customary law amidst the social changes of modern society.

AUTOETHNOGRAPHY AND SPIRITUAL EPISTEMOLOGY IN MUSLIM WOMEN’S LIFE WRITING

Hermawatie, Niela Agustin, Maknun, Lu'luil
Abstract: This article explores autoethnography as a form of spiritual epistemology in the study of Islam and gender. Drawing upon feminist hermeneutics and Indonesian Muslim women’s lived experiences, it argues that self-writing… g is not merely personal expression but a mode of knowing an intellectual and devotional act that integrates reason, emotion, and faith. Using a qualitative reflective framework, the author employs her own journey as a Muslim woman, mother, and doctoral scholar to examine how autoethnography can serve as both method and ibadah ilmiah. The discussion situates this approach within Islamic concepts of tafakkur (contemplation) and muhasabah (self-accounting), connecting them to the works of Amina Wadud, Etin Anwar, and Saba Mahmood. Findings reveal three epistemic dimensions of spiritual self-writing: (1) writing as worship and remembrance, (2) domestic space as an epistemic field of ethical formation, and (3) reflexive authorship as a feminist-spiritual act of reclaiming authority. By merging autoethnography with Islamic historiography, this study proposes an inclusive and embodied mode of scholarship — one that honors lived experience as a source of divine and intellectual illumination.

SYSTEMATICS OF THE HADITH PERSPECTIVE ON THE PHENOMENON OF ONLINE GAMBLING

Andi Fadhil Andi Aderus, Abdul Rahman Sakka, Siti Aisyah
Abstract: The term "khitbah" refers to the rituals involved in proposing marriage between a man and a woman, or between a man and a woman. The words "khitbah" (proposing) and "zawaj" (marrying/getting married) are defined differently… tly in all hadith volumes. Similarly, conventions distinguish between males who are engaged and those who are married, and the Shari'ah makes a clear distinction between the two. Just as the Qur'an discusses marriage (including proposals), the Prophet's hadith also describes marriage proposals, which is the first step in continuing the practice to the level of marriage, and the author here presents a thematic interpretation study of the hadith pertaining to sermons.

Pendekatan Feminis terhadap Narasi 2 Samuel 13:1-39 dan Implikasinya terhadap Kekerasan Seksual di Lingkungan Keluarga

Liandra Yolanda Camerling, Alelen Darmas Singerin
Abstract: Sexual violence can occur in any environment, including the family. Most victims of sexual violence are women. One narrative depicting violence in a family context is the story of Tamar and Amnon in 2 Samuel 13:1-39, which… ch is part of King David’s family history. The family, which should be a place of refuge, instead becomes an unsafe place. The patriarchal system that gives power to men and places women in a subordinate position is one of the causes. The text of 2 Samuel 13:1-39 is implied in the modern context because the problem of sexual violence in private spaces such as the home is also experienced by women today. A feminist approach is used to draw out women’s values and analyze the structure of the Davidic Kingdom family, identifying the causes and impacts, and how Tamar, as a woman, faced and overcame the moral crisis and sexual violence she experienced. This study uses a qualitative descriptive method with a hermeneutic approach, focusing on literature review to discuss related topics. The author found that Tamar, who experienced sexual violence in the family environment, did not receive justice. The cause of violence is the patriarchal system.  Power struggles and invalid laws. Tamar did not remain silent but sought justice for herself by communicating her experiences to the public through religious and social symbolism. Learning from Tamar teaches modern women how to speak out about the injustices they experience.
