Domestic Violence: Comparison between Islamic Law and Domestic Violence

Abstract: The purpose of this study was to determine the comparison between Islamic Law and Domestic Violence Law in handling domestic violence in Indonesia. The type of research used is qualitative research with comparative descriptive… iptive method. As the only research design, the ethnographic method is the method in this research with descriptive analysis writing techniques, where ethnography itself provides a tool that allows the research process to take place better. The results of this study are from two sources of law, namely Islamic Law and Domestic Violence Law which can be used as a legal basis to punish and limit the arbitrariness of a husband against his wife and family members. In addition, the two sources of law view the need for formal juridical protection of a person's human rights and freedoms, preventing arbitrary acts of violating other people's laws without clear or justified reasons. The conclusion of this study is that there is a relationship between Islamic Law and the Domestic Violence Law, including 1) The views of Islamic law and positive law view that domestic violence or violence against wives is a despicable and promiscuous behavior; 2) Correlation about the purpose of punishment; 3) In terms of punishment, it can be said that punishment in the form of imprisonment is a form of takfir punishment in Islamic criminal law.

Human Rights And Public Policy Implementation : Narcotics

Abstract: This research discusses the relationship between Human Rights (HAM) and the implementation of public policies related to narcotics. In a global context, narcotics policies are often a source of controversy due to their impact… mpact on individual rights. This research evaluates how narcotics policies can affect basic rights such as the rights to life, liberty, health and justice. In some cases, harsh legal crackdowns on narcotics have led to human rights violations, such as arbitrary arrest and detention, as well as the use of force by security forces. On the other hand, some countries have tried alternative approaches, including decriminalization or legalization of narcotics, with the aim of reducing the negative impact on individuals. This research uses a normative approach. The conclusion from this research is that it is important to maintain a balance between efforts to prevent and handle narcotics with protecting individual human rights. Effective implementation of narcotics policies must take into account the basic rights of individuals and seek to reduce negative social impacts. This research underlines the need for a holistic and sustainable approach in dealing with narcotics issues without compromising human rights

Abstract: Anak adalah generasi penerus masa depan bangsa dan Negara Indonesia, oleh karena itu anak memerlukan pembinaan dan bimbingan khusus, baik dari keluarga, masyarakat, maupun pemerintah agar dapat tumbuh kembang secara maksimal.… imal. Dalam hal ini pemerintah telah berupaya memberikan perlindungan hukum terhadap anak-anak Indonesia dengan meratifikasi Konvensi Hak Anak serta menerbitkan berbagai peraturan perundangan yang merumuskan perlindungan terhadap anak-anak yang berhadapan dengan hukum, yang salah satu implementasi adalah dengan lahirnya Undang Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak. Salah satu kasus yang diangkat menjadi fenomena dalam dunia kriminalitas dan konteks perlindungan anak di Indonesia yang memerlukan solusi dalam penyelesaiannya adalah kasus genk motor khususnya yang terjadi di Kota. Kasus genk motor yang terjadi telah merugikan banyak pihak dan mengganggu keamanan dan ketertiban kota Pekanbaru karena para anggota genk motor ini melakukan tindak pidana yang mengancam keselamatan masyarakat. Namun adanya penyelesaian sudut pandang yang berbeda dari Pihak Kepolisian dengan Pihak Lembaga Perlindungan Anak dalam menangani keputusan dalam kasus tersebut   Children are the future generation of the Indonesian nation and state, therefore children need special guidance and guidance, both from family, society and the government so that they can grow and develop optimally.  In this case, the government has attempted to provide legal protection for Indonesian children by ratifying the Convention on the Rights of the Child and issuing various laws and regulations that formulate protection for children in conflict with the law, one of the implementations of which is the enactment of Law Number 23 of 2002 About Child Protection. One of the cases that has become a phenomenon in the world of crime and the context of child protection in Indonesia which requires a solution is the motorbike gang case, especially the motorbike gang case harmed many parties and disrupted the security and order because members of this motorbike gang committed criminal acts that threatened the safety of the people. However, there are different points of view from the Police and the Child Protection Agency in handling decisions in this case.
