Tasyabbuh dalam Perayaan Valentine: Kajian Hadis dan Persepsi Generasi Z Muslim Indonesia

Abstract: This study examines the Islamic legal status of Valentine's Day celebrations through a hadith based approach and explores how Indonesian Muslims understand the phenomenon. The study addresses the tension between the prohibition… ibition of tasyabbuh in the hadith “Man tasyabbaha bi qaumin fahuwa minhum” and the growing practice of Valentine's Day celebrations among young Muslims. Using a sequential mixed-methods design, the study combines desk research including analysis of the sanad, matn, and fiqh of hadith from six journal articles and one primary hadith source with an online survey of 47 Indonesian Muslims aged 16–28 selected through purposive and snowball sampling. The textual analysis found that the hadith is hasan (Islamic law) and that the prohibition of tasyabbuh specifically relates to the imitation of religious symbols and rituals, not all forms of cultural practices. The survey findings support this conclusion: most respondents understand the hadith (80.9%), have never actively celebrated Valentine's Day (89.3%), and believe the prohibition applies primarily to religious or symbolic imitation (55.3%). This study concludes that the primary concern among contemporary Indonesian Muslims is not the religious origins of Valentine's Day, but rather the associated practices, particularly khalwat, which risk violating sharia principles.

Implementation of the Waiting List Policy in the Administration of the Hajj Pilgrimage at the Office of the Ministry of Religious Affairs of Central Maluku Regency

Abstract: This study analyzes the implementation of the waiting list policy in the administration of the Hajj pilgrimage at the Office of the Ministry of Religious Affairs of Central Maluku Regency. A descriptive qualitative approach… ach was used to examine how the policy is translated into public service practices, particularly in a local context where the waiting period has reached approximately 18 years, with about 2,500 prospective pilgrims and an annual quota of 135 people. Data were obtained through interviews, observation, and document review involving officials responsible for Hajj and Umrah services and relevant community informants. The data were analyzed using the interactive model of Miles, Huberman, and Saldana, consisting of data condensation, data display, and conclusion drawing. The findings show that policy implementation is supported by four interrelated factors: bureaucratic structure, resources, communication, and the disposition of implementing officers. A clear organizational structure and standard operating procedures facilitate coordination and accountability. Competent human resources, adequate facilities, and the use of Siskohat strengthen service accuracy and transparency. Multi-channel communication helps reduce misunderstanding, while professional and empathetic officer attitudes build public trust. The novelty of this study lies in its local-level analysis of Hajj waiting list implementation in an archipelagic regency. The study implies that transparent, responsive, and humanistic public services are essential for maintaining fairness and legitimacy in long-term Hajj queue management.

Kepatuhan Prosedural dalam Penegakan Hukum PETI dan Dampaknya terhadap Pemulihan Ekosistem Hutan Tropis di Pohuwato, Indonesia

Abstract: Penelitian ini menganalisis keterkaitan antara kepatuhan prosedural penegakan hukum terhadap penambangan emas tanpa izin (PETI) di Kabupaten Pohuwato, Indonesia, dengan pemulihan ekosistem. Melalui studi kasus terstruktur,&#8230; r, dokumentasi hukum 14 bulan, observasi lapangan, dan analisis citra satelit dievaluasi terkait kepatuhan terhadap KUHAP pada tiga tahap penegakan hukum (penyidikan, penuntutan, persidangan) serta indikator lingkungan (tutupan vegetasi, konsentrasi merkuri, keanekaragaman hayati). Temuan utama menunjukkan bahwa kasus yang mematuhi ketat timeline KUHAP mencapai pemulihan ekosistem 40% lebih cepat dibanding kasus tertunda. Pohuwato mencatat tingkat konversi menjadi vonis bersalah 75% (di atas rata-rata nasional 60%), dengan korelasi positif kuat (r=0,87; p<0,01) antara kualitas bukti lingkungan forensik dan keberhasilan penuntutan. Bukti konsentrasi merkuri terbukti sangat efektif, menghasilkan vonis bersalah pada 90% kasus. Meski aktivitas PETI menurun 85% dalam radius 5 km pasca-penindakan, peningkatan tutupan vegetasi hanya 15% dalam 6 bulan, mengindikasikan kecepatan pemulihan ekologis yang lebih lambat. Signifikan bahwa 70% tersangka menyatakan kesiapan berpartisipasi dalam program restorasi, berkorelasi signifikan dengan integrasi bukti ilmiah (r=0,79; p<0,05). Hasil ini membuktikan bahwa efisiensi prosedur hukum tidak hanya menghentikan kerusakan lebih lanjut, tetapi juga menjadi fondasi kritis bagi percepatan pemulihan ekosistem. Studi ini menjembatani celah penelitian dengan menghubungkan secara empiris kepatuhan prosedur hukum dengan hasil lingkungan, sekaligus menantang pendekatan ekonomi pertambangan yang berpusat pada Eropa. Implikasi praktis mendesak pelatihan khusus bukti lingkungan bagi jaksa dan pedoman operasional integrasi data ilmiah ke dalam proses hukum. Temuan ini menyediakan landasan aksi bagi penyelarasan kerangka hukum Indonesia dengan realitas konservasi, sekaligus menawarkan model perlindungan hutan tropis bagi negara berkembang kaya sumber daya.

The Effect of Algorithmic Performance Appraisal on Employee Trust in Digital and Technology-Based Companies

Abstract: This study examines how employees perceive and trust Algorithmic Performance Appraisal (APA) in digital-native and technology-driven companies. Adopting Organizational Justice Theory, the Trust in Technology Framework, and&#8230; nd Cognitive Appraisal Theory, the research explores both the direct and indirect effects of APA on employee trust, with Perceived Procedural Fairness (PPF) as a mediating variable. The study uses a quantitative, cross-sectional approach, collecting data from 200 employees in technology-based organizations and analyzing the data with Partial Least Squares Structural Equation Modeling (PLS-SEM). Results show that APA significantly enhances both procedural fairness and employee trust, with PPF playing a partial mediating role in this relationship. These findings underscore the importance of transparency, procedural legitimacy, and avenues for employee voice in cultivating trust in algorithmic systems. The study’s theoretical contribution lies in its integration of multiple perspectives on trust and fairness within algorithmic HR management. The practical implication calls for the careful design and implementation of APA systems that employees perceive as fair and trustworthy. Future research should investigate these relationships in longitudinal and multi-contextual settings to deepen the understanding of trust dynamics in evolving AI-mediated work environments.

Manajemen Hubungan Masyarakat Dalam Meningkatkan Partisipasi Masyarakat Terhadap Kualitas Pendidikan Islam Di Pondok Pesantren Insan Kaffah Tenjo Bogor

Abstract: Penelitian ini mengkaji peran manajemen hubungan masyarakat dalam meningkatkan keterlibatan masyarakat terhadap integritas pendidikan Islam di Sekolah Islam Asrama Insan Kaffah di Tenjo, Bogor. Latar belakang penelitian&#8230; ini menggambarkan pentingnya masyarakat sebagai pemangku kepentingan dalam mendukung lembaga pendidikan, terutama dalam hal pembiayaan, infrastruktur, dan pengembangan kurikulum. Tujuan penelitian ini adalah untuk mengevaluasi efektivitas strategi manajemen hubungan masyarakat dalam meningkatkan keterlibatan masyarakat. Formulasi masalah berkaitan dengan implementasi manajemen PR dan faktor-faktor yang mendukung serta menghambatnya. Metode penelitian yang digunakan adalah deskriptif kualitatif, dengan memanfaatkan dokumentasi, observasi, dan wawancara untuk mengumpulkan data. Sekolah Islam Asrama Insan Kaffah telah menerapkan manajemen hubungan masyarakat secara efektif melalui program rutin, termasuk kelompok studi agama, gotong royong, dan kegiatan sosial, yang telah meningkatkan partisipasi masyarakat, menurut hasil penelitian. Namun, hambatan tetap ada, termasuk keterbatasan sumber daya dan kurangnya kesadaran di kalangan sebagian anggota masyarakat. Temuan penelitian ini menekankan pentingnya perencanaan strategis, evaluasi berkelanjutan, dan pemberdayaan masyarakat.

The Prospect of Legalizing Casinos with Strict Regulations as a Strategy for Optimizing State Revenue and Social Control in Indonesia

Abstract: The discourse on casino legalization in Indonesia arises as a response to the widespread illegal gambling that remains difficult to eradicate despite being prohibited under the Criminal Code (KUHP), Law No. 7 of 1974, and&#8230; d the Electronic Information and Transactions Law (ITE). The gap between legal norms (das sollen) and social reality (das sein) shows that prohibition alone has not been effective. This research uses a qualitative method with a normative juridical approach based on legislation and a comparative approach, particularly examining Malaysia and Singapore, which have successfully managed casinos through strict regulations. The findings indicate that casino legalization in Indonesia could serve as an alternative fiscal policy, provided that clear regulations are established, ensuring economic benefits such as increased state revenue and effective control over illegal gambling, without undermining national morals and values.

The Transition from Conventional Constitutions to Digital Law: Constitutional Law Challenges in the Age of Artificial Intelligence

Abstract: The rapid advancement of digital technology and artificial intelligence (AI) in the twenty-first century has fundamentally transformed the structure of modern constitutional governance. Digitalization has reshaped the interactions&#8230; teractions between governments and citizens, altered the patterns of political participation, and presented major challenges to constitutional principles. This study aims to analyze the implications of technological development for constitutional law and propose the concept of a digital constitution as an adaptive framework in the AI era. This study employs a normative legal method, using both conceptual and statutory approaches. Legal materials consist of primary, secondary, and tertiary sources, which are analyzed qualitatively and descriptively. The findings reveal that, while digital transformation enhances governmental efficiency and public transparency, it also generates serious risks, including data misuse, digital surveillance, and political disinformation. These dynamics demand a reinterpretation of constitutional norms to protect citizens' digital rights in cyberspace. The concept of a digital constitution is proposed as a normative response that integrates digital rights into constitutional rights and reaffirms the principle of the rule of law within technological governance. To achieve a democratic and just constitutional order, it is crucial to strengthen regulatory frameworks, ensure algorithmic accountability, and foster collaboration among state institutions, civil society, and the private sector. Ultimately, constitutional law must evolve into an adaptive, transparent, and fair system that can address the profound challenges of the digital and AI-driven era.

Constitutionality Testing of Presidential Candidacy Thresholds in Elections Based on the Principle of Popular Sovereignty

Abstract: This study critically examines the constitutionality of Indonesia’s presidential candidacy threshold under Article 222 of Law No. 7 of 2017 in relation to the principle of popular sovereignty in Article 1(2) of the 1945&#8230; 5 Constitution. The threshold requiring a party or coalition to hold 20% of DPR seats or 25% of the popular vote has been controversial for limiting voter choice and reinforcing oligarchic dominance. Using a normative legal research method, the study applies doctrinal interpretation through grammatical, systematic, historical, and teleological approaches to evaluate whether the threshold is consistent with constitutional democracy. The analysis identifies a disconnect between the legislative rule and the constitutional concept of sovereignty residing with the people, informed by theories of democracy, sovereignty, and progressive legal thought. While procedurally legitimate, the threshold lacks substantive constitutional validity because of its exclusionary impact on political participation. The study proposes four reform options: repeal, proportional adjustment, judicial reinterpretation, and constitutional amendment. These reforms would realign electoral rules with democratic principles and restore voters’ political agency. A doctrinal reinterpretation model is offered, framing the threshold as a regulatory instrument rather than a rigid barrier, advocating a legal structure that promotes inclusivity and reflects the people’s general will.

Principles of Emotions Affecting Learning and Social Learning in Elementary School

Abstract: This study aims to develop a comprehensive constellation model and identify optimal strategies for strengthening lecturers’ professional commitment in the largest private universities in Bogor. Penelitian ini mengkaji secara&#8230; secara mendalam bagaimana emosi dan belajar sosial memengaruhi proses pembelajaran di sekolah dasar melalui perspektif neuropedagogik dan brain‑based learning. A mixed methods approach was used by combining quantitative analysis (meta-analysis of 173 respondents and 47 indicators of NP, EC, OB, MS, BS) and descriptive qualitative analysis using thematic analysis techniques on semi-structured interviews with five elementary school teachers. The meta-analysis results showed a very strong average effect of the latent construct relationship (t(128) = 12.92; p < 0.001; r ≈ 1.00) with almost zero heterogeneity (Qₑ(128) = 1.67; τ² = 0; I² = 0%), and no significant moderating effects were found for all indicators; the partial meta-regression coefficients for all items were very close to zero and the R² value was 0.000. Qualitatively, three main themes emerged: (1) positive emotions as the foundation of learning readiness, (2) social interaction as a reinforcement of meaning formation, and (3) contextual learning that integrates cognitive, emotional, and social dimensions. Although most teachers have not yet mastered the concepts of neuropedagogy and brain-based learning theoretically, they have intuitively implemented its principles through motivation, praise, humor, group work, collaborative projects, and learning experiences relevant to students' real lives. These findings support the latest theory that places emotions and social interactions as the main drivers of brain function in learning (Immordino Yang, 2016; Tyng et al., 2017; Vygotsky, 1978; Jensen, 2008), and emphasizes the importance of strengthening teachers' competence in understanding and designing brain- and emotion-based learning to support the holistic development of elementary school students.

Integration of Neuroscience Principles in Science Learning Media: A PICO-Based Systematic Literature Review

Abstract: Science education at the elementary school level plays a crucial role in fostering scientific thinking, curiosity, and problem-solving skills from an early age. Nevertheless, science instruction in elementary schools often&#8230; en remains teacher-centered, verbalistic, and insufficient in promoting meaningful scientific literacy. In response to these challenges, neuroscience provides a theoretical and empirical foundation for designing learning media that align with how the brain processes, stores, and retrieves information. This study aims to systematically examine the integration of neuroscience principles into science learning media and their effects on elementary students' scientific literacy. A Systematic Literature Review (SLR) was conducted using the PICO framework (Population, Intervention, Comparison, Outcome). Relevant peer-reviewed studies published between 2019 and 2024 were retrieved from Scopus, Google Scholar, ERIC, and DOAJ databases. The review followed four stages: identification, selection, quality appraisal, and thematic synthesis. The results indicate that neuroscience-based interventions—such as Augmented Reality (AR), Brain-Based Learning (BBL), interactive multimedia, and multisensory instructional strategies—consistently improve students' motivation, attention, conceptual understanding, critical thinking, and scientific literacy compared to conventional instructional approaches. The novelty of this study lies in its systematic synthesis of neuroscience-based science learning media through a PICO-oriented framework, highlighting the interaction between cognitive, affective, and technological dimensions of learning. The findings provide important implications for science education, particularly in guiding the development of neuroscience-informed learning media and instructional designs to enhance scientific literacy in elementary schools.
