LEGAL ACTION AGAINST WITHDRAWALWAKAF PROPERTY(Decision Study No. 22/Pdt.G/2017/MS-Aceh)

Jiko
Abstract: Withdrawal of Waqf Assets based on Decision No. 22/Pdt.G/2017/MS-Aceh because the objects which are waqf assets belonging to the Bireueen Islamic Education Society have been misused by the Bireueen Ministry of Religious… Affairs in a dysfunctional manner, namely the waqf objects are recorded as Public Property. In order for the irregularity of the waqf assets to be in accordance with the waqf pledge made, the owner of the waqf rights takes over the waqf assets. The validity of Nazir as the owner of the waqf rights in the event of misappropriation of waqf assets based on Resolution no. 22/Pdt.G/2017/MS-Aceh is reviewed from the provisions of Article 42 of Law Number 41 of 2004 concerning Waqf which explains: "It is the duty of nazhir to manage and dispose of waqf assets for their intended use, according to their function and designation." So that the waqf assets that were originally borrowed by the owner of the waqf rights can be disposed of if there is misuse of waqf assets. The Judge's reason for permitting the takeover of misused waqf assets in Decision no. 22/Pdt.G/2017/MS-Aceh, based on the findings of the facts by the Judge, is of the opinion that legally there is no legal justification for the Defendant/Applicant to hold objects that are unlawfully and unlawfully owned and managed as YPI Bireuen's claim property.

Social Reality of Employment in Bengkulu Province: Policy Analysis of Programs, Obstacles, and Challenges

Reza Oktaviani, Ahnaf, Nugraha, Santi, Jannah, Diah Nadiatul
Abstract: Employment is an activity undertaken by individuals to earn income in order to sustain a decent standard of living. Employment relationships are established through agreements between employers and workers, and such agreements… ements should ensure decent work conditions. However, in reality, there is insufficient government supervision in ensuring the fulfillment of workers’ rights in accordance with Law No. 13 of 2003. The distribution of rights for female workers is also not optimally implemented. In addition, workforce skills remain a concern, as many workers only possess primary to junior secondary education. Furthermore, freelance work has become increasingly popular due to its flexibility in time and location. Therefore, solutions are needed to address employment issues in Bengkulu Province. Data collection in this study was conducted through interviews with the Bengkulu Provincial Manpower Office. Data analysis employed a qualitative approach. The findings indicate that many workers are engaged in seasonal sectors with unstable income. The Bengkulu Provincial Manpower Office has implemented programs such as job fairs, vocational training and education, and occupational health and safety socialization. Generation Z is perceived as less loyal and tends to frequently change jobs, showing a strong preference for freelance work due to its flexibility. Policy development is needed to provide legal protection for workers. Recommended actions include stricter enforcement against companies violating labor rights, particularly those committing violence against female workers, conducting awareness programs in collaboration with the Ministry of Women’s Empowerment and Child Protection and labor protection institutions, and optimizing integrated reporting systems to accelerate the resolution of such cases.

The Value And Strength Of Evidence Of The Testimonium De Auditu Witness In The Case Of Sexual Abuse Of Children

Vincentius Patria Setyawan
Abstract: Disclosure of a criminal case in order to find the perpetrator of a criminal act cannot be separated from witness statements as evidence. Witness testimony that is recognized as evidence is only testimony that meets subjective… ective and objective requirements as a witness. In this regard, problems often arise in practice regarding testimonium de auditu witnesses, related to the strength of their evidence before the trial. For certain criminal acts, finding witnesses who saw, heard and experienced the crime is not easy. For example, criminal acts of sexual abuse against children, which are difficult to find because when a criminal act of sexual abuse occurs, at that time there must be only the perpetrator and the victim. The aim of this research is to determine the value and evidentiary strength of the testimony of testimonium de auditu witnesses in the process of proving criminal acts of child molestation. This problem will be answered using normative legal research methods through case studies of Decision Number: 146/Pid.Sus/2020/PN Ktg. The results of the research in writing this article are that the evidentiary value of all evidence, including witnesses, is in the hands of the judge. Judges in determining the value and proof of evidence must pay attention to its suitability with other evidence.

This research applies a qualitative approach with a descriptive method. The study was conducted at Mutiara 17 August Elementary School, Edelweiss School, and Bina Pelita Bangsa Elementary School. Data were collected through in-depth interviews, observations, and documentation involving Nalanda students, principals, and homeroom teachers in five elementary schools. The data analysis technique employed was the interactive model of Miles and Huberman. The results reveal that Nalanda students act as value educators by instilling principles such as loving-kindness (mettā), responsibility, discipline, and respect for parents and teachers. The strategies used include role modeling, habituation in Buddhist spiritual practices, integration of values in learning, and personal approaches to students. Abstract: The territory of Indonesia is a high level of earthquake risk among several earthquake areas around the world. One way to reduce the occurrence of potential damage to building construction is to utilize waste and metal as… s added material from coarse and fine aggregate to the flexural strength of beams that have equivalent flexural strength. The equivalent flexural strength value tends to increase with the addition of metal fibers. This study aims to determine the effect of adding metal fibers to the flexural strength of the beam and the pattern of cracks and collapse mechanisms that occur in the beam when the object is tested. This research is a type of quantitative research with physical laboratory experimental methods. The data collection method used is a preliminary study, The selection of the type of aggregate and metal fiber and secondary data were then carried out laboratory tests for the gradation of fine aggregate and coarse aggregate. The data analysis technique is linear regression analysis in the Ms. program. Excell to determine the effect of metal fibers as additives on the flexural strength of the mixing of coarse and fine aggregates.
