Abstract:Pemberlakuan Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana membawa perubahan penting dalam sistem pemidanaan Indonesia, termasuk pengaturan mengenai pengulangan tindak pidana sebagai dasar pemberatan…
beratan pidana.
The enactment of Law Number 1 of 2023 concerning the Criminal Code has brought important changes in the Indonesian penal system, including regulations regarding the repetition of criminal acts as the basis for criminal charges. This study aims to analyze the reformulation of recidivism regulations in the National Criminal Code as the basis for criminal charges, especially in building clearer, systematic, and more legal certainty regulations. This research uses a prescriptive normative legal research method by examining laws and regulations and legal materials relevant to the regulation of recidivism and criminal charges. The results of the study show that the regulation of recidivism in the old Criminal Code through Article 486, Article 487, and Article 488 has a limited character because the charges are associated with certain groups of criminal acts. This condition creates complexity in implementation and requires proper identification of the criminal history of the perpetrator. The National Criminal Code through Article 23 provides a more structured regulation regarding the repetition of criminal acts based on the grace period and characteristics of the criminal act, while Article 58 letter c places the repetition of criminal acts as a factor that aggravates the crime and Article 59 regulates the limit of the aggravation of a maximum of one-third of the maximum criminal threat. The reformulation shows an effort to clarify the relationship between the repetition of a criminal act and the aggravation of a criminal offense. However, its application still needs to pay attention to proportionality, legal certainty, the purpose of criminalization, coaching, prevention of repetition, and social reintegration. Thus, the reformulation of recidivism needs to be directed at a consistent and measurable construction so that criminal repetition is not only oriented towards increasing the severity of sanctions, but also supports the prevention of recidivism. Such an arrangement is expected to be able to provide a more definite guideline for judges and law enforcement officials in applying the burden to perpetrators who repeat criminal acts.
Abstract:Program Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan program strategis nasional untuk mempercepat pendaftaran tanah guna mewujudkan kepastian hukum hak atas tanah.
The Complete Systematic Land Registration (PTSL) program is a national strategic program intended to accelerate land registration and realize legal certainty over land rights. Its mass implementation may result in discrepancies between physical and juridical data that can affect the validity of land title certificates. This study analyzes the forms of physical and juridical data discrepancies in PTSL, their legal consequences for certificate validity, potentially liable parties, and available settlement mechanisms. This normative juridical study employs statutory, conceptual, case, and comparative approaches by examining primary, secondary, and tertiary legal materials supported by case documentation from the Serang Regency Land Office. The findings indicate that discrepancies in physical data, including differences in area, boundaries, and overlapping plots, as well as discrepancies in juridical data, including identity errors, defective bases of title, and multiple claims, may result in administrative and/or juridical defects in certificates. The PTSL Adjudication Committee bears primary institutional responsibility, assisted by the Physical and Juridical Task Forces, while the Land Office and applicants may also be held responsible where negligence or fault is proven. Settlement is conducted progressively according to the nature of the problem, ranging from data correction and mediation to certificate cancellation through administrative or judicial mechanisms.
Abstract:This paper explores the critical role civil law plays in the protection and promotion of human rights within national legal systems. Unlike criminal or constitutional law, civil law provides individuals with direct legal…
remedies through mechanisms such as tort claims, contract enforcement, and family law proceedings. By enabling victims of human rights violations to seek restitution, compensation, or injunctions, civil law serves as an essential tool for ensuring accountability and redress. The study analyzes key civil law principles and case examples to demonstrate how they contribute to safeguarding fundamental rights such as equality, privacy, property, and access to justice. It concludes that a robust civil legal framework is indispensable for translating human rights principles into enforceable protections in everyday life.
Abstract:Community service initiatives grounded in coastal ecosystems represent a tangible manifestation of the non-military defense paradigm, which is increasingly relevant in addressing multidimensional threats. The activity, conducted…
onducted by the Faculty of Defense Strategy at the Republic of Indonesia Defense University (Unhan RI) in Kampung Bahari Nusantara, Sidodadi Village, Teluk Pandan Subdistrict, Pesawaran Regency, South Lampung, on May 22, 2026, involved the planting of 5,000 mangrove seedlings, environmental education, and the distribution of basic food aid to 300 fishers. This article analyzes these activities within the conceptual frameworks of coastal area resilience, sustainable ecosystem management, and the synergy between defense institutions, academia, and local communities. Employing a descriptive-qualitative approach through participatory observation and literature review, the findings indicate that mangrove rehabilitation not only contributes to mitigating coastal abrasion and climate change impacts but also strengthens the socio-economic resilience of coastal communities and serves as a vehicle for instilling the values of national defense among students. This activity recommends the reinforcement of the Kampung Bahari Nusantara program as a model for inclusive and sustainable coastal empowerment and proposes the integration of the silvofishery concept to enhance the economic value of mangrove conservation.
Abstract:This study aims to understand the communication used by the leader, describe employee work discipline, and analyse the leadership communication strategy used to improve work discipline at the Somolo-Molo District Office.…
A descriptive qualitative case-study design was employed. Seven informants were selected purposively: one key informant (the District Head), two main informants (the District Secretary and the Head of General Affairs Subdivision), and four supporting informants (employees/staff). Data were collected through interviews, observation, and documentation and analysed through data reduction, data display, conclusion drawing, and verification. The findings show that leadership communication is open and two-way and combines meetings, assemblies, direct communication, letters/dispositions, digital media, and informal communication. Work discipline is categorised as fairly good but not yet fully consistent. In measurable qualitative terms, all seven informants described attendance as generally maintained, while all seven also identified occasional lateness and the need for stronger consistency; effective use of working hours, leave/out-of-office reporting, and completion of some tasks still require reminders. Leadership communication is implemented through informative, persuasive, educational, repetitive, role-modelling, personal coaching, supervision, gradual reprimand, proportionate firmness, evaluation, and positive reinforcement approaches. Identified improvements include better punctuality, more orderly absence reporting, more effective use of working hours, and faster task completion. Sustainable discipline requires consistent rule enforcement, routine briefings, documented follow-up, multichannel communication, and exemplary conduct across all levels of leadership.
Abstract:This study is motivated by the Election Vulnerability Index (IKP) in South Tangerang, which categorizes money politics as a high-risk indicator, alongside a female registered voter list (DPT) that exceeds the male demographic…
aphic by 18,727 individuals—a condition frequently exploited through grassroots channels for covert vote-buying. This research analyzes the application of the Elaboration Likelihood Model (ELM) in the persuasive communication strategies employed by female election supervisors at Bawaslu to prevent vote-buying in the 2024 General Election. This study aims to: describe the forms of persuasive communication utilized by female supervisors; identify the media and communication channels employed; and analyze the effects of this persuasive communication in fostering anti-money politics awareness through the lens of ELM. A descriptive qualitative approach with a case study method was employed, using purposive sampling for informant selection. The findings indicate that the persuasive communication strategy combines interpersonal communication and informal small-group communication. Female supervisors applied identification techniques by shedding formal agency attributes and adapting their diction to everyday vernacular to diminish psychological distance with the community. The communication media comprised physical flyers creatively transformed into digital graphics and disseminated through digital interpersonal and social channels, specifically community WhatsApp groups (neighborhood units, Family Welfare Empowerment/PKK, and informal social gatherings/arisan). Based on the ELM analysis, this strategy successfully shifted the cognitive processing of community members toward the Central Route. A comfortable, nondistracting communication setting initially facilitated audience receptivity via the peripheral route, while clear substantive information regarding two-way criminal liability (penalizing both givers and receivers) functioned as high-quality arguments that heightened personal relevance and motivation. Reinforced by physical symbolic gestures rejecting vote-buying to lock in commitment, the application of ELM proved effective in fostering an autonomous, stable, enduring, and resistant moral stance against money politics.
Abstract:The growth of the gig economy in Indonesia has triggered significant transformations in the traditional labour structure. This study aims to analyse the impact of the gig economy on workers' employment patterns, income,…
and social protection using a literature review method. The results of the analysis show that the gig economy offers flexibility and new employment opportunities but also increases income uncertainty and widens the social protection gap between gig and traditional workers. In addition, there is a skills disruption that requires increased digital literacy and worker adaptability. This research recommends the need for labour regulation reform, strengthening portable social security systems, and expanding access to digital training so that the gig economy can provide inclusive and sustainable benefits for the entire Indonesian workforce.
Abstract:Climate change is increasingly recognized as a major driver of internal displacement, particularly in fragile states like Libya where environmental shocks intersect with political instability and weak governance. This study…
udy investigates how climate-induced internal displacement affects social cohesion in Libya’s coastal cities, focusing on Tripoli, Misrata, and Benghazi. Using a qualitative research design, data were collected through in-depth interviews, focus group discussions, and field observations involving internally displaced persons (IDPs), host community members, and local stakeholders. Findings reveal that environmental factors such as drought and flooding have forced vulnerable populations to migrate from Libya’s interior regions to urban coastal centers. These displacements have strained public services, exacerbated competition for resources, and led to growing tensions between displaced populations and host communities. Social trust, mutual support, and access to services have all been undermined, while IDPs often face legal invisibility, psychological stress, and marginalization. Despite these challenges, the research identifies promising local initiatives that have fostered integration and rebuilt social ties, including joint livelihood programs and inclusive municipal governance efforts. However, these efforts remain fragmented and unsustainable without broader policy support. The study concludes that to prevent further erosion of social cohesion, Libya must adopt a national legal framework to recognize and protect climate-displaced persons, strengthen municipal capacities, and integrate displacement considerations into urban planning and climate adaptation strategies. This article contributes to emerging literature on climate migration and urban resilience by providing grounded, context-specific insights into how environmental displacement reshapes the social fabric in post-conflict settings.
