hesizing information from diverse references, including books, journals, and previous research. The findings of this study reveal that the education budget encompasses the allocation of funds used to facilitate educational services. Whether for public schools or governmental entities (at both central and regional levels), the authority for budget utilization is governed by legal frameworks. Nationally, the Ministry of Education and Culture (Kemendikbud) and the Ministry of Research, Technology, and Higher Education (Kemenristek Dikti) play pivotal roles in determining the education budget, specifying its sources and objectives. At the regional level, Provincial, District, and City governments, through the Education Service Unit (Satker Dinas Pendidikan), are accountable for planning and overseeing the utilization of education budgets in line with their respective jurisdictions and discretion. Simultaneously, at the school level, active involvement in planning and executing agreed-upon school programs funded by the budget is undertaken by the school principal in collaboration with the school community.
Abstract:The presence of a child can be a link between couples. However, in fact, some married couples cannot have children, even though they really need children in their domestic life. So the effort to care for or hug a child then…
hen becomes an option to get a child even though he is not a natural child. The law states that the purpose of adopting a child is simply to improve the welfare of the child. This research aims to find out and examine Islamic legal regulations regarding the inheritance rights of adopted children. The position of children in Islamic law is still attributed to their biological guardians and not to their adoptive fathers. Moreover, in Islamic inheritance law, adopted children do not get inheritance privileges from the father who supports them, but the freedom of inheritance returns to the biological father of the child being cared for. Children raised in Islam can acquire property from their supportive father through a bequest course and then a mandatory will course. Since taking over, the children and their supportive father have been seen as having been a huge help in their respective lives. Therefore, as a substitute for the freedom inherited from the younger generation, Islamic law provides a way through mandatory gifts and wills.
Abstract:Ancient Israelite tradition reflects a patriarchal social structure that positioned men at the center of social, legal, and religious authority, resulting in limitations on women’s rights and roles, including access to inheritance…
inheritance law. This article addresses theological and juridical issues concerning the mechanism of legal change through the narrative of the daughters of Zelophehad in Numbers 27:1-11, which constitutes a significant turning point in Israelite legal tradition. The research problem focuses on the lack of attention in previous studies to the theological meaning of God’s decision in Numbers 27:7, as earlier research has tended to emphasize socio-cultural aspects, contextual relevance, or purely linguistic analysis. This study employs a qualitative approach based on a literature review, utilizing Hebrew textual exegesis, analysis of Israel’s patriarchal context, and a critical reading through the lens of feminist theology. The findings indicate that the daughters of Zelophehad’s claim was not merely a response to a legal vacuum, but a conscious action that positioned women as active subjects in the process of legal formation. God’s decision affirming their claim underscores divine justice that transcends the limitations of the patriarchal system and corrects institutionalized structural injustice. The conclusion affirms that this narrative presents God as the source of justice who sides with the restoration of the dignity of marginalized groups and opens space for women’s participation as agents of legal change. The novelty of this study lies in its theological interpretation that positions women not only as recipients of inheritance rights, but as pioneers of legitimate and divinely recognized legal transformation. These findings contribute to the development of feminist theology and Old Testament legal studies, while also providing a reflective foundation for gender equality discourse in contemporary theological and religious practice across cultures.
Abstract:This study explores the concept of covenant in the Pentateuch through a qualitative-descriptive approach that integrates historical and theological analysis of God’s covenants with Noah, Abraham, and Israel at Sinai. Historical…
istorical findings indicate that the covenantal structures in the Pentateuch correspond to treaty forms common in the Ancient Near East, particularly suzerainty treaties, yet the biblical covenants reveal a fundamental distinction by emphasizing God’s gracious initiative independent of political negotiations or human strategic interests. The theological examination affirms that the covenant is not merely a legalistic contract but a manifestation of God’s relational commitment that shapes the identity of His people as a covenant community grounded in divine faithfulness and promise. The Torah is understood as an expression of faith response arising from this covenantal relationship, rather than a prerequisite for salvation, thereby retaining its significance for the contemporary church as an ethical and spiritual framework guiding Christian praxis, character formation, and communal responsibility amid rapidly evolving social contexts. The integration of historical and theological perspectives demonstrates that the Pentateuchal covenant encompasses intertwined dynamics of grace, obligation, and identity formation, contributing theoretically to Old Testament studies, particularly covenant theology, while offering practical implications for ecclesial faith formation, the strengthening of communal spirituality, and ministry orientation rooted in a holistic understanding of the divine–human relationship. This research underscores the urgency of interpreting the Pentateuchal covenant through an interdisciplinary lens to meet the theological, ethical, and pastoral challenges faced by the church in the contemporary era.
Abstract:Market manipulation practices in the Indonesian capital market have the potential to harm investors, distort fair price formation, and undermine market integrity. These conditions require effective supervision by the Financial…
ancial Services Authority (Otoritas Jasa Keuangan—OJK) as the institution authorized to regulate and supervise capital market activities. This study aims to analyze the legal framework governing OJK's supervision of market manipulation practices, assess the effectiveness of its implementation, and identify the factors influencing the success of such supervision. This study employed a normative legal research method using statutory and conceptual approaches. Legal materials were collected through library research and analyzed qualitatively. The findings indicate that OJK's supervisory authority is supported by a strong legal framework under Law Number 8 of 1995 concerning the Capital Market and Law Number 21 of 2011 concerning the Financial Services Authority. Nevertheless, the effectiveness of supervision continues to face challenges arising from technological developments, the increasing complexity of market manipulation schemes, and limitations in supervisory capacity. This study concludes that strengthening institutional capacity, optimizing the use of technology, and enhancing inter-agency coordination are essential to improving investor protection and maintaining the integrity of the capital market. The novelty of this study lies in its integrated analysis of the legal framework, supervisory effectiveness, and technology-based market manipulation challenges within a single analytical framework.
Abstract:This study examines the resolution of non-performing financing in Islamic financial institutions, which have experienced significant growth but are confronted with increasing risks of non-performing financing (NPF) that…
may undermine institutional stability and public trust. The research problem focuses on the suboptimal mechanisms for resolving problematic financing, the existence of a gap between legal norms and their practical implementation, and the lack of integration of philosophical approaches within the framework of Islamic economic law. This study aims to analyze resolution mechanisms from the perspective of Islamic economic law, identify the factors contributing to the normative–practical gap, and formulate a more comprehensive and equitable resolution model. The method employed is normative juridical, utilizing statutory and case approaches, with secondary data analyzed qualitatively through deductive reasoning. The findings indicate that the resolution of non-performing financing is still predominantly characterized by restructuring measures that are administrative in nature and fail to address root causes, while litigation pathways remain relatively ineffective due to procedural and substantive constraints. The disparity between legal norms and practice suggests that legal implementation has not fully reflected the principles of substantive justice. The study concludes by emphasizing the necessity of reconstructing resolution mechanisms through the integration of normative, empirical, and philosophical dimensions. The novelty of this research lies in the development of a maqāṣid al-sharī‘ah-based resolution model that offers a holistic approach oriented toward justice, public welfare, and the balance of interests, thereby providing more effective, contextual, and sustainable solutions within the Islamic financial system in Indonesia.
