The data used is secondary data obtained in ready-made form from the Department of Industry and Trade (DISPERINDAG) and the Department of Manpower and Transmigration (DISNAKERTRANS) during 2016-2020. The data analysis technique in this study is multiple regression analysis using SPSS. Based on the results of multiple regression analysis, it can be concluded that investment has a positive and significant effect on employment in the industrial sector and the minimum wage has a positive and insignificant effect on employment.

This study focuses on the regulation of rewards for inmates working in correctional facilities, as well as an evaluation of the fairness aspect in their distribution. The study adopts a normative legal analysis approach, utilizing primary legal sources such as laws and government regulations, as well as additional references discussing inmates’ rights in correctional institutions, particularly those related to the payment system for the work they perform. The study finds that the regulations governing inmates’ rights, including those related to wage distribution, are outlined in Article 14 of Law No. 12 of 1995, Government Regulation No. 32 of 1999, and the Minister of Justice Decree No. M.01-PP.02.01 of 1990. From the researcher’s perspective, the distribution of rewards aligns with the principle of fairness because, in addition to receiving rewards, inmates also receive valuable skill training for their future after leaving the correctional institution.

Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual, dan pendekatan perbandingan hukum (comparative approach). Bahan hukum diperoleh melalui studi kepustakaan atas Al-Qur’an, hadis, kitab-kitab fikih muamalah, peraturan perundang-undangan, serta jurnal hukum mutakhir, yang selanjutnya dianalisis secara deskriptif-kualitatif. Hasil penelitian menunjukkan bahwa konsep ijarah bi al-’amal menempatkan upah sebagai hak yang harus dipenuhi secara adil, proporsional, dan tepat waktu, sebagaimana ditegaskan dalam Al-Qur’an Surah At-Talaq ayat 6, Surah Al-Qashash ayat 26-27, dan hadis riwayat Ibnu Majah. Prinsip tersebut memiliki keselarasan nilai dengan semangat Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan sebagaimana diubah dengan Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja serta Peraturan Pemerintah Nomor 36 Tahun 2021 tentang Pengupahan, meskipun keduanya berbeda pada aspek sumber otoritas, mekanisme penetapan upah minimum, dan bentuk sanksi. Penelitian ini merekomendasikan agar nilai-nilai ijarah bi al-’amal, khususnya prinsip maqashid syariah, diintegrasikan sebagai basis etik dalam pembaruan kebijakan pengupahan nasional, terutama untuk melindungi pekerja pada sektor informal dan ekonomi gig yang belum sepenuhnya terjangkau oleh regulasi ketenagakerjaan formal.
Wages are a fundamental right of workers that must be protected, both from the perspective of positive law and Islamic law. This study aims to examine the concept of ijarah bi al-’amal in Islamic law as a philosophical foundation for wage protection, and to compare it with wage regulations under Indonesia’s Manpower Law. The results show that ijarah bi al-’amal positions wages as a right that must be fulfilled fairly, proportionally, and in a timely manner, as affirmed in the Quran Surah At-Talaq verse 6, Surah Al-Qashash verses 26-27, and the hadith narrated by Ibn Majah. This study employs a normative legal method with statutory, conceptual, and comparative approaches, examining legal materials from the Quran, hadith, classical fiqh literature, statutory regulations, and recent legal journals. The findings reveal that the principles of ijarah bi al-’amal align with the spirit of Law Number 13 of 2003 on Manpower as amended by Law Number 6 of 2023 on Job Creation and Government Regulation Number 36 of 2021 on Wages, although they differ in terms of the source of authority, minimum wage determination mechanisms, and forms of sanctions. This study recommends integrating the values of ijarah bi al-’amal, particularly maqashid syariah principles, as an ethical basis for reforming national wage policy, especially to protect informal and gig-economy workers not yet fully covered by formal labor regulations.

lly utilized by the locals because of their busy work as laborers who depend on wages. This is compounded by the very strict working hours that leave workers no time to utilize the blessing as additional income. In dealing with this situation, breeding catfish using tarpaulin method is likely the most appropriate alternative solution for the locals to earn more income without having to leave their main job as factory workers. This is possible as the catfish cultivation using tarpaulin method is effortless and does not consume much time to manage it. Moreover, with the annual increase in demand for catfish consumption in the surrounding regions as well as competitive selling prices (ranging from IDR14,000 to IDR17,000 per kilogram) making tarpaulin cultivation of catfish solution for the locals in Dukuh Rejosari. The method used in this service was socialization by providing outreach and training from the catfish cultivation expert. The result shows that villagers are enlightened to have a new source of income in the midst of busyness working as laborers.

Abstrak: Berlokasi di kaki gunung Merbabu, Dukuh Rejosari dianugerahi dengan pemandangan yang indah, cuaca yang sejuk, dan lahan yang subur untuk bercocok tanam seperti kopi, teh, jagung, dan tembakau. Namun hal belum dimanfaatkan secara maksimal oleh para penduduk dikarenakan kesibukan mereka sebagai pekerja buruh harian yang bergantung pada upah pabrik. Hal ini diperparah dengan jam kerja yang sangat padat membuat para pekerja tidak memiliki waktu lebih untuk memanfaatkan lingkungan sebagai tambahan penghasilan. Dalam menghadapi situasi tersebut, pengembangbiakan ikan lele dengan menggunakan terpal merupakan solusi alternatif yang paling tepat guna memberi para penduduk penghasilan lebih tanpa harus meninggalkan pekerjaan utama mereka sebagai buruh pabrik. Hal ini dimungkinkan karena budidaya lele terpal sangat mudah dilakukan dan tidak memerlukan banyak waktu untuk merawatnya. Juga, dengan peningkatan tahunan permintaan ikan lele konsumsi di daerah sekitar serta harga jual yang kompetitif (berkisar Rp. 14.000,- – Rp. 17.000,- per kilogram) menjadikan budidaya ternak lele terpal sebagai alternatif paling ideal untuk memberikan tambahan penghasilan kepada masyarakat Dukuh Rejosari. Metode yang digunakan adalah metode sosialisasi dengan memberikan pelatihan dari pembudidaya lele terpal berpengalaman. Hasil dari kegiatan ini yaitu masyarakat mendapatkan kesempatan untuk membentuk sumber pendapatan baru ditengah-tengah kesibukan bekerja sebagai buruh pabrik.

The results of this research show that first, the participation of personnel from the Lingat village community in development programs taking place in Lingat village is still minimal because the community's awareness of responsibility for development programs is low for which people are willing to work if they are given wages. Second, there are also material participants from the Lingat village community who give for free or willingly, but there are also those who give by asking for something in return. Third, community participation in maintaining and enjoying development in Lingat village is good, because the community participates in enjoying the results of development in the village, for this reason the Lingat village community is responsible for maintaining development in Lingat village so that it can be used together.Based on the results of the research above, the Lingat village government is advised to look at and follow up on these matters by providing socialization to the Lingat village community about the responsibilities, rights and obligations of the community in every development program that occurs in the village, especially in Lingat village, Selaru sub-district. Hasil penelitian menunjukkan bahwa, meskipun regulasi mendukung perlindungan ini, pelaksanaan di lapangan masih terkendala diskriminasi gender dan kurangnya kepatuhan perusahaan terhadap aturan yang ada. Penelitian ini merekomendasikan peningkatan pengawasan, penegakan hukum, serta sosialisasi untuk menjamin terpenuhinya hak-hak tenaga kerja perempuan secara merata dan konsisten.
This research discusses legal protection for female workers in Indonesia by examining aspects of employment law and the principles of gender equality. The main focus is an analysis of women's labor rights, including fair wages, occupational health and safety protection, as well as maternity leave policies, which are guaranteed in labor regulations and international instruments that Indonesia has ratified. The research results show that, although regulations support this protection, implementation in the field is still hampered by gender discrimination and a lack of company compliance with existing regulations. This research recommends increasing supervision, law enforcement and outreach to ensure the fulfillment of women's labor rights evenly and consistently.
