UTILIZATION OF AGILE METHODS TO DEVELOP EMPLOYEE INTERPERSONAL SKILLS: A SYSTEMATIC LITERATURE REVIEW

Abstract: Abstract: Interpersonal skills in employees are an important part of technology companies in achieving their goals through the development of skills in their employees.  The application of agile methods for application development… development has been widely carried out by technology companies.  The agile method has the main principle of communication between employees, requiring skills to face these principles.  The method used in this study is the systematic literature review (SLR) method to know how the use of agile methods can develop interpersonal skills in karyawan.  In the initial search conducted using the Publish or Perish application, 740 journals were found in the range of 2015 to 2022. Next, journal filtering and cluster search continued using Microsoft Excel, Zotero, Mendeley, and VOS Viewer applications, resulting in 53 journals selected based on Q1. In the final stage of screening, researchers re-screened 9 journals that were used as a reference regarding the use of agile methods to develop employee interpersonal skills.  The results showed that the agile development method can affect the development of employee interpersonal skills. 11 skills develop because of the use of this agile development method including team working, emotional intelligence, negotiation and persuasion, problem-solving, communication skills, conflict resolution, decision making, time management, organizational skills, listening, and relationship building. Of the 11 skills, the most mentioned is team working.             Keywords: agile development methods; interpersonal skills; literature review   Abstrak: Interpersonal skill pada karyawan menjadi bagian penting bagi perusahaan teknologi dalam mencapai tujuannya melalui berbagai pengembangan keterampilan. Penerapan metode agile untuk pengembangan aplikasi sudah banyak dilakukan oleh perusahaan-perusahaan teknologi. Metode agile memiliki prinsip utama berupa komunikasi antar karyawan sehingga membutuhkan keterampilan untuk menghadapi prinsip-prinsip tersebut. Metode yang digunakan pada penelitian ini yaitu metode systematic literature review (SLR) dengan tujuan untuk mengetahui bagaimana pemanfaatan metode agile dapat mengembangkan interpersonal skill pada karyawan. Pada pencarian awal yang dilakukan menggunakan aplikasi Publish or Perish, ditemukan 740 jurnal pada rentang tahun 2015 sampai 2022. Selanjutnya, penyaringan jurnal menggunakan aplikasi Microsoft Excel dan Mendeley Desktop yang menghasilkan 53 jurnal yang dipilih berdasarkan penilaian kualitas. Pada tahap akhir penyaringan, peneliti menyaring kembali menjadi 9 jurnal yang digunakan sebagai acuan mengenai pemanfaatan metode agile untuk mengembangkan interpersonal skills karyawan. Hasil penelitian menunjukan bahwa metode agile development dapat mempengaruhi pengembangan interpersonal skill karyawan, faktanya terdapat 11 skill yang berkembang karena pemanfaatan metode agile development ini diantaranya adalah team working, emotional intelligence, negotiation and persuasion, problem solving, communication skills, conflict resolution, decision making, time management, organizational skill, listening, dan relationship building. Legal Protection For Consumers In Digital Transactions: Case Study And Analysis

Abstract: This study aims to analyze the effectiveness of legal protection for consumers in digital transactions in Indonesia. The method used is library research with a normative juridical approach. The results of the study indicate… ate that Indonesia actually has an adequate legal basis to protect digital consumers, which is primarily sourced from Law Number 8 of 1999 concerning Consumer Protection and Law Number 19 of 2016 concerning Information and Electronic Transactions. These regulations have set out basic principles such as the obligation of business actors to provide honest information, consumer rights to security, and the recognition of electronic evidence. However, its implementation in the field encounters various significant obstacles. Case studies on e-commerce and fintech platforms reveal that consumer losses still often occur, such as products that do not match the description, difficulties with refunds, and the vulnerability of personal data. The key finding of this study is that the main challenge lies not in the legal vacuum, but in three aspects: (1) low digital literacy and consumer law so that they are not optimal in fighting for their rights; (2) alternative dispute resolution mechanisms such as BPSK and ODR (Online Dispute Resolution) which are not yet effective, fast, and easily accessible; and (3) weak supervision and law enforcement against unscrupulous business actors in the digital space. Therefore, it is concluded that digital consumer protection efforts require a holistic approach that relies not only on regulations, but also through massive public education, strengthening dispute resolution institutions, and closer synergy between the government, business actors, and the community.

Efektivitas Kewenangan Pengadilan Agama Dalam Menyelesaikan Sengketa Ekonomi Syariah

Jalur litigasi adalah mekanisme penyelesaian sengketa dengan menggunakan pendekatan hukum (law approach) yaitu melalui… lui lembaga hukum dan aparat hukum yang berwenang. Sedangkan jalur non-litigasi adalah mekanisme penyelesaian sengketa dengan mekanisme yang hidup di dalam masyarakat seperti musyawarah dan perdamaian. Dalam hal ini sering disebut sebagai Alternative Dispute Resolution (ADR) sebagaimana diatur dalam Undang-Undang Nomor 30 Tahun 1999 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa. Penelitian ini dibuat dengan tujuan untuk mengetahui efektivitas kewenangan pengadilan agama dalam menyelesaikan sengketa ekonomi syariah. Penelitian ini menggunakan jenis Penelitian hukum normatif ini menggunakan metode pendekatan perundang-undangan dan pendekatan konsep, teknik Pengumpulan bahan hukum dilakukan dengan studi pustaka. Hasil penelitian ini Menurut data pada Direktori Putusan Mahkamah Agung Republik Indonesia, sengketa ekonomi syariah yang masuk di Pengadilan Agama dari periode tahun 2018 sampai dengan tanggal 2020 yang berjumlah 57.655 Perkara, sedangkan pada arbritase syariah sejak 2018 sampai dengan 2020 ada sebanyak 247 perkara. Berdasarkan data ini dapat disimpulkan bahwa dalam menyelesaikan sengketa ekonomi syariah, kewenangan pengadilan agama sudah efektif.

Penyelesaian Sengketa Ekonomi Syariah Pada Arbitrase

With the rapid growth of Sharia-based financial industries, the need for effective dispute resolution… in accordance with Sharia economic principles becomes increasingly pressing. Arbitration is considered a relevant alternative compatible with Islamic law in handling Sharia economic conflicts. This study will trace the Islamic legal principles applicable in arbitration and analyze the success and challenges of Sharia economic dispute resolution through the arbitration process. Additionally, the research will review the role of arbitration institutions and regulations supporting Sharia dispute resolution. Thus, this study provides in-depth insights into the potential of arbitration as an effective means of resolving Sharia economic disputes and its contribution to the global development of Sharia-based financial systems.

LEGAL ACTION AGAINST WITHDRAWALWAKAF PROPERTY IN MEDAN

Abstract: Withdrawal of Waqf Assets based on Decision No. 22/Pdt.G/2017/MS-MEDAN because the objects which are waqf assets belonging to the Bireueen Islamic Education Society have been misused by the Bireueen Ministry of Religion… in a dysfunctional manner, namely the waqf objects are recorded as Public Property. In order for the irregularity of the waqf assets to be in accordance with the waqf pledge made, the owner of the waqf rights takes over the waqf assets. The validity of Nazir as the owner of the waqf rights in the event of misappropriation of waqf assets based on Resolution no. 22/Pdt.G/2017/MS-MEDAN is reviewed from the provisions of Article 42 of Law Number 41 of 2004 concerning Waqf which explains: "It is the duty of nazhir to manage and dispose of waqf assets for their intended use, according to their function and designation." So that the waqf assets that were originally borrowed by the owner of the waqf rights can be disposed of if there is misuse of waqf assets. The Judge's reason for permitting the takeover of misused waqf assets in Decision no. 22/Pdt.G/2017/MS-MEDAN, based on the findings of the facts by the Judge, is of the opinion that legally there is no legal justification for the Defendant/Applicant to hold objects that are unlawfully and unlawfully owned and managed as YPI Bireuen's claim items.

Legal Certainty Regarding Sharia Banking Dispute Resolution In The Context Of Constitutional Court Decision Number 93/PUU/X/2012

This is where the need for certainty of law in settling the dispute in question arises, and how the Constitutional Court's decision for certainty of law can be realized in Islamic banking disputes. The research method used is descriptive normative. Research results explain that the Decision of the Constitutional Court Number 93/PUU/X/2012 confirms certainty of law by deleting dualism of authority justice, making the Religious Court as an institution the sole authority to finish Islamic banking through track litigation. Thus, it can be concluded that this decision cancels the explanation of Article 55 paragraph (2) of the Sharia Banking Law, eliminates forum selection to the District Court; however, it still allows non-litigation settlement, such as Sharia arbitration. The settlement process of disputes in Islamic banking, as arranged in Article 55 paragraph (1), (2), and (3) of the Sharia Banking Law, has given duties and authorities to courts in the neighborhood religious courts.

Social Reality of Employment in Bengkulu Province: Policy Analysis of Programs, Obstacles, and Challenges

Abstract: Employment is an activity undertaken by individuals to earn income in order to sustain a decent standard of living. Employment relationships are established through agreements between employers and workers, and such agreements… ements should ensure decent work conditions. However, in reality, there is insufficient government supervision in ensuring the fulfillment of workers’ rights in accordance with Law No. 13 of 2003. The distribution of rights for female workers is also not optimally implemented. In addition, workforce skills remain a concern, as many workers only possess primary to junior secondary education. Furthermore, freelance work has become increasingly popular due to its flexibility in time and location. Therefore, solutions are needed to address employment issues in Bengkulu Province. Data collection in this study was conducted through interviews with the Bengkulu Provincial Manpower Office. Data analysis employed a qualitative approach. The findings indicate that many workers are engaged in seasonal sectors with unstable income. The Bengkulu Provincial Manpower Office has implemented programs such as job fairs, vocational training and education, and occupational health and safety socialization. Generation Z is perceived as less loyal and tends to frequently change jobs, showing a strong preference for freelance work due to its flexibility. Policy development is needed to provide legal protection for workers. Recommended actions include stricter enforcement against companies violating labor rights, particularly those committing violence against female workers, conducting awareness programs in collaboration with the Ministry of Women’s Empowerment and Child Protection and labor protection institutions, and optimizing integrated reporting systems to accelerate the resolution of such cases.

Sharia Insurance Disputes Through Sharia Arbitration: A Legal Discourse

Abstract: Sharia insurance in Indonesia is growing, because along with the increasingly complex disputes between parties, which cannot be avoided between Islamic insurance companies and policyholders, this is even though both of them… hem help and protect each other. The problem is regarding the legal basis for sharia insurance dispute resolution which is still scattered in several laws and regulations. This has become a discourse and issue of legal norms for sharia arbitration as an option for sharia insurance dispute resolution, and so far the resolution of sharia insurance disputes through sharia arbitration is regulated by Supreme Court Regulation Number 14 of 2016. The research method used is descriptive normative. The research method used is descriptive normative by analyzing regulations laws governing sharia dispute resolution. The results of this study explain that state policy in managing sharia insurance disputes is still a discourse, so that constitutional authority still uses Article 58 of Law no. 48 of 2009 concerning Judicial Power. Therefore, it is necessary to amend Law No. 30 of 1999, specifically regarding the article regarding the District Court, which must be supplemented by the Religious Courts and procedures for resolving disputes through sharia arbitration.
