Abstract:The Suspension of Debt Payment Obligations (PKPU) is a legal procedure that allows debtors who are unable, or expect to be unable, to continue paying their due and collectible debts to seek legal recourse. Debtors in such…
h situations can initiate legal action during the PKPU process. However, the question arises: what is the legal certainty for creditors following the Constitutional Court's decision that encourages debtors to pursue legal action? This study uses a descriptive normative research method to analyze the legal issues related to such actions. The findings indicate that the legal recourse available to debtors in specific circumstances significantly impacts creditors. This leads to uncertainties regarding payment, especially if the debtor decides to file for legal action. Additionally, these uncertainties can affect the creditor's business operations. The Constitutional Court's decision, subsequently reinforced by a Circular Letter from the Supreme Court, does not adequately address the gaps in legal certainty faced by creditors. This situation complicates creditors' efforts to secure their rights, which are the obligations of the debtor.
Abstract:The Malacca Strait is a vital maritime route that faces significant challenges from high traffic volumes and increasingly frequent extreme weather scenarios. These conditions pose serious risks to navigational safety, environmental…
vironmental integrity, and maritime operational security. This study aims to analyse the needs and components of a robust maritime surveillance architecture in the Malacca Strait, particularly in dealing with the impacts of extreme weather and climate change. Additionally, this research will explore the role of geospatial maritime intelligence in enhancing situational awareness and response to maritime incidents. The study findings indicate that a resilient surveillance architecture in the Malacca Strait requires the integration of advanced sensor systems (including multi-spectral radar and meteorological/oceanographic sensors), redundant communication networks, and AI/ML-based intelligent data processing. The adaptive capabilities of the system, including the use of UAVs and USVs, are critical to maintaining operational effectiveness in adverse weather conditions. Additionally, international cooperation and a robust policy framework, encompassing climate change adaptation and ethical considerations, are fundamental to the successful implementation and sustainability of surveillance systems. The Malacca Strait case study highlights specific vulnerabilities and proposes concrete solutions, illustrating a shift from a reactive to a proactive paradigm in maritime security. Building a resilient surveillance architecture in the Malacca Strait is a strategic imperative to safeguard global trade, regional stability, and environmental sustainability amid increasing climate uncertainty. Integrating cutting-edge technology with robust policies and international collaboration will ensure the safety and security of this vital waterway, making it a model for resilient maritime governance globally. A new aspect emphasised is the importance of adapting to climate change and the role of AI in predictive decision-making. This article presents a comprehensive and integrated approach to building a resilient maritime surveillance architecture, with a particular focus on the challenges of extreme weather in the Malacca Strait. Its originality lies in its emphasis on multi-sensor data fusion, the role of artificial intelligence in predictive analytics, and the integration of climate change adaptation into surveillance system design. Additionally, the article underscores the importance of a robust policy framework and international cooperation as the cornerstones of maritime surveillance resilience, offering a blueprint applicable to other critical maritime routes worldwide
Abstract:This study explores international communication management in the Department of Investment and One-Stop Integrated Services (DPMPTSP) of East Java in the context of cultural differences. The main findings indicate that DPMPTSP…
PMPTSP operates in an environment with cultural dimensions such as low power distance, individualism, masculinity, low uncertainty avoidance, and long-term orientation. This affects the way the institution communicates and manages its international relations. The study found that adapting communication that is sensitive to cultural differences, including values, attitudes, and etiquette, is essential to improving operational effectiveness and efficiency. The novelty of this study lies in the in-depth understanding of the application of Hofstede's cultural theory in the context of international communication management in the public sector, as well as practical recommendations to overcome cultural challenges in international interactions.

ective and objective requirements as a witness. In this regard, problems often arise in practice regarding testimonium de auditu witnesses, related to the strength of their evidence before the trial. For example, criminal acts of sexual abuse against children, which are difficult to find because when a criminal act of sexual abuse occurs, at that time there must be only the perpetrator and the victim. The aim of this research is to determine the value and evidentiary strength of the testimony of testimonium de auditu witnesses in the process of proving criminal acts of child molestation. This problem will be answered using normative legal research methods through case studies of Decision Number: 146/Pid.Sus/2020/PN Ktg. The results of the research in writing this article are that the evidentiary value of all evidence, including witnesses, is in the hands of the judge. Judges in determining the value and proof of evidence must pay attention to its suitability with other evidence.
Abstract:Legal system development certainly cannot be separated from sociological developments that include customs, norms, culture, and religion. In terms of rapid economic development, no doubt, a country is required to have a…
rule of law that can accommodate these needs and could cover various sociological spectrums that exist and are constantly changing within its people. Indonesia as a country with the largest Muslim majority in the world, while the notion of the whole state is based on Pancasila with diverse customs and cultural norms is certainly faced with several challenges, one of which is the transformation and the implementation of living law that includes religious, as well as indigenous law into a state law. The field of economics as an example of a social event that continues to revolve, will significantly be affected in the development of legal and social science. Sharia law is no longer a codification of exclusive law limited to certain groups of people but has become a general rule not only in Indonesia but also internationally with the existence of Islamic banking system. This phenomenon certainly changes the view of the legal order that applies in society if the change is assessed through the eyes of the sociology of law in Indonesia.
