The Complete Systematic Land Registration (PTSL) program is a national strategic program intended to accelerate land registration and realize legal certainty over land rights. Its mass implementation may result in discrepancies between physical and juridical data that can affect the validity of land title certificates. This study analyzes the forms of physical and juridical data discrepancies in PTSL, their legal consequences for certificate validity, potentially liable parties, and available settlement mechanisms. This normative juridical study employs statutory, conceptual, case, and comparative approaches by examining primary, secondary, and tertiary legal materials supported by case documentation from the Serang Regency Land Office. The findings indicate that discrepancies in physical data, including differences in area, boundaries, and overlapping plots, as well as discrepancies in juridical data, including identity errors, defective bases of title, and multiple claims, may result in administrative and/or juridical defects in certificates. The PTSL Adjudication Committee bears primary institutional responsibility, assisted by the Physical and Juridical Task Forces, while the Land Office and applicants may also be held responsible where negligence or fault is proven. Settlement is conducted progressively according to the nature of the problem, ranging from data correction and mediation to certificate cancellation through administrative or judicial mechanisms.
The trademark registration system in Indonesia adopts the first-to-file principle; however, its application is subject to the requirement that registration be conducted in good faith. Issues may arise when a trademark resembles one that has already been registered or previously applied for and is subsequently registered by another party with improper intentions. Therefore, this study aims to analyze the provisions concerning bad faith in the trademark registration process under Law Number 20 of 2016 concerning Trademarks and Geographical Indications. This study also examines the forms of legal protection available to registered trademark owners against registrations made in bad faith by referring to Decision Number 1 PK/Pdt.Sus-HKI/2025. Using a normative juridical research method with a statutory and case approach, the study finds that bad faith may constitute a basis for rejecting a trademark registration application as provided under Article 21 paragraph (3), while also serving as a limitation on the application of the first-to-file principle. Legal protection for registered trademark owners is provided preventively through substantive examination and rejection of applications, and repressively through the filing of trademark cancellation lawsuits as regulated under Articles 76 and 77.
Abstract:This study is motivated by the Election Vulnerability Index (IKP) in South Tangerang, which categorizes money politics as a high-risk indicator, alongside a female registered voter list (DPT) that exceeds the male demographic…
aphic by 18,727 individuals—a condition frequently exploited through grassroots channels for covert vote-buying. This research analyzes the application of the Elaboration Likelihood Model (ELM) in the persuasive communication strategies employed by female election supervisors at Bawaslu to prevent vote-buying in the 2024 General Election. This study aims to: describe the forms of persuasive communication utilized by female supervisors; identify the media and communication channels employed; and analyze the effects of this persuasive communication in fostering anti-money politics awareness through the lens of ELM. A descriptive qualitative approach with a case study method was employed, using purposive sampling for informant selection. The findings indicate that the persuasive communication strategy combines interpersonal communication and informal small-group communication. Female supervisors applied identification techniques by shedding formal agency attributes and adapting their diction to everyday vernacular to diminish psychological distance with the community. The communication media comprised physical flyers creatively transformed into digital graphics and disseminated through digital interpersonal and social channels, specifically community WhatsApp groups (neighborhood units, Family Welfare Empowerment/PKK, and informal social gatherings/arisan). Based on the ELM analysis, this strategy successfully shifted the cognitive processing of community members toward the Central Route. A comfortable, nondistracting communication setting initially facilitated audience receptivity via the peripheral route, while clear substantive information regarding two-way criminal liability (penalizing both givers and receivers) functioned as high-quality arguments that heightened personal relevance and motivation. Reinforced by physical symbolic gestures rejecting vote-buying to lock in commitment, the application of ELM proved effective in fostering an autonomous, stable, enduring, and resistant moral stance against money politics.

ory challenges faced in the context of the gig economy and cross-border remote work and evaluate the policy responses from various countries. The method used is a literature review by examining scientific literature, national and international regulations, and related policy reports. The results showed that the unclear legal status of workers, differences in regulations between countries, taxation issues, and limited social protection are the main obstacles. This research recommends the need for adaptive regulatory reforms and international collaboration to create an inclusive and equitable legal framework to support sustainable growth of the digital economy and protect workers' rights.
Abstract:This study aims to analyse the implementation of bureaucratic reform and its impact on public service transparency in Indonesia. Through a qualitative approach with a literature review, this study found that bureaucratic…
reforms carried out through organisational restructuring, simplification of procedures, strengthening human resources, and the use of information technology have encouraged the creation of more open and accountable public services. The digitisation of services and the public complaints system expanded public access to information and increased participation in service oversight. The results show that public service transparency has improved significantly, although challenges remain in terms of apparatus resistance and infrastructure limitations. Thus, bureaucratic reform plays an important role in realising governance that is transparent, efficient and responsive to the needs of society.
Abstract:The word Maisir in Arabic literally means to obtain something very easily without hard work or to gain profit without working. It is anything that involves gambling, betting or risky games. Another term used in the Quran…
is the word `azlam' which means the practice of gambling. Economic activity plays a vital role in creating a prosperous, just and prosperous society. Islam teaches in the economic system of its ummah, based on the values of justice that must be upheld, and become the main principle for conducting economic activities. Every economic activity must contain elements of benefit and not mistreatment of himself and others, so that economic activity can create community welfare equally. Conducting economic activities is not allowed to be done if it contains elements of gharar, maysir and usury or taking the rights of others by false means. In the Qur'an letter al-Baqarah: 219 and surat al- Ma'idah: 90 and 91, it is known that gambling is an abominable act that is forbidden by Islam. The scholars also said that gambling (maisir) is a game where the winner gets a certain amount of money or goods without reasonable effort and can make people fall into the valley of poverty because it contains three elements, namely games/competitions, there is a bet, luck. Today's modern conventional (non-sharia) businesses generally contain three elements that are prohibited in Islamic economic ideology, namely gharar, maisir and riba. This happens not separated from the reality of conventional business development trends and not widespread awareness and coverage of economic services based on Islamic economics. Bank Muamalat Indonesia (BMI) is the first purely Islamic bank in Indonesia which in principle all of its main products both in the service of Financing Strategy products (deposits funds) and financing products (financing) based on the Islamic system (profit sharing). BMI seeks to implement aspects of Islamic economic ideology that consistently avoids gharar, maisir and usury.
Abstract:Compensation is part of the resource management function which is related to various types of rewards that individuals receive as rewards for employees who have carried out their work duties. The total reward received by…
employees who have done their work is managed by the company by creating a policy which is also known as input-output exchange between the company and its employees. To optimally understand the nature of compensation, the types and forms of compensation and the benefits of compensation, it can be viewed from the science of philosophy. Compensation is discussed in detail using philosophy through the dimensions of ontology, epistemology, and axiology. So, with this aim, organizations or companies can get a complete picture of compensation and can make efforts to optimize compensation so that it can bring positive benefits and prevent negative things that can arise if it is not handled correctly. This research discusses compensation from a philosophical perspective in the dimensions of ontology, epistemology and axiology using a qualitative approach. The research results show that from the perspective of philosophical knowledge, compensation can be explained in three dimensions, namely: ontology, epistemology, and axiology. In the ontological dimension, compensation includes the true meaning of compensation which can be proven to exist in every organization. The epistemological dimension of compensation is related to the basic science, forms, characteristics, and types of all existing compensation. Finally, in the axiological dimension, the discussion of compensation includes the relationship between compensation and value, namely the feasibility of compensation to be developed, as well as the function and benefits of compensation in the organization. In the end, compensation needs to be managed so that it can provide more optimal benefits in the continuity of an organization's activities.
Abstract:The rapid integration of financial technology (FinTech), artificial intelligence (AI), and social media has transformed global investment behavior, reshaping the psychological dynamics of modern investors. This paper examines…
mines how digital technologies amplify behavioral biases such as overconfidence, herding, and recency bias within contemporary financial markets. Using a descriptive qualitative approach supported by literature synthesis and case studies, it explores the interplay between investor psychology and technological systems. Findings indicate that while FinTech platforms democratize access to financial markets, their gamified features and algorithmic personalization reinforce impulsive and emotionally driven trading. AI-based advisory systems, though designed to enhance decision accuracy, often introduce automation bias and confirmation loops that distort rational judgment. Social media ecosystems further accelerate herding and emotional contagion by promoting conformity through peer validation and viral sentiment. The study highlights ethical and regulatory challenges associated with behavioral exploitation and algorithmic transparency, emphasizing the need for robust investor protection frameworks and behavioral literacy programs. Ultimately, it concludes that technology in finance must balance innovation with responsibility, ensuring that digital tools empower investors without amplifying cognitive biases or undermining market integrity.
Abstract:The rapid expansion of digital communication technologies has transformed the structure of human interaction within hyperconnected societies. This study examines the emergence of digital intimacy and its implications for…
the decline of authentic human presence in contemporary communication practices. Using a qualitative conceptual approach grounded in communication theory, media ecology, existential philosophy, and critical digital studies, this article explores how social media platforms, algorithmic systems, and virtual interaction reshape intimacy, identity, and relational experience. The findings reveal that hyperconnectivity produces a paradoxical condition in which individuals remain continuously connected yet increasingly experience emotional fragmentation, loneliness, performative communication, and communicative fatigue. The study introduces the concept of “presence erosion” to explain the weakening of embodied interaction and existential closeness caused by excessive technological mediation. Furthermore, the article argues that digital capitalism commodifies emotional expression and social interaction through engagement-driven communication systems that prioritize visibility over authenticity. Although digital technologies provide opportunities for global connectivity and social participation, they simultaneously threaten the depth of human relationships by replacing direct presence with symbolic and algorithmic interaction. This study contributes to global communication scholarship by offering an interdisciplinary theoretical framework for understanding the crisis of presence in digital civilization. Ultimately, the article emphasizes the importance of reconstructing communicative ethics grounded in empathy, attentiveness, and authentic human engagement within increasingly mediated social environments.
