LEGAL PROTECTION FOR VICTIMS WRONGLY ARRESTED IN THE INVESTIGATION PROCESS IN INDONESIA

Burhayan, Mujiburrahman
Abstract: This study discusses legal protection for victims of wrongful arrest during the investigation process in Indonesia. As a state governed by law, Indonesia guarantees the protection of human rights, including for those who… become victims of procedural errors in the justice system. Wrongful arrests constitute a violation of individual freedom and cause physical, psychological, and social suffering. This research employs a normative legal method, drawing on statutory and literature sources. The results show that victims of wrongful arrest are entitled to compensation and rehabilitation, as provided for in the Indonesian Criminal Procedure Code (KUHAP) and Law Number 48 of 2009 concerning Judicial Power. However, compensation provided is still limited to material aspects and has not fully restored the victims’ dignity, reputation, and well-being. Therefore, the state must strengthen legal protection mechanisms and ensure that investigations are conducted professionally, transparently, and in accordance with human rights principles to prevent the recurrence of wrongful arrest cases.

Fora, Yandri, Saluy, Ahmad Badawi
Abstract: This study aims to synthesize findings from empirical studies on factors that influence employee performance and productivity in the context of modern organizations in Indonesia and beyond. Employee performance and productivity… ctivity are crucial elements for the success and sustainability of organizations amidst intense business competition and dynamic changes in the work environment, including adaptation to work models such as Work From Home (WFH). This article uses a qualitative literature study method on articles/journals covering various key variables such as organizational/work culture, work environment, compensation, motivation, job satisfaction, organizational commitment, workload, work discipline, work stress, and work-life balance. The results of the analysis indicate a complex and interrelated relationship between these variables. It is consistently found that a positive organizational culture, intrinsic and extrinsic motivation, and organizational commitment have a significant influence on improving performance and productivity. A conducive work environment and job satisfaction often act as important mediators in this relationship. However, the influence of variables such as compensation, workload, and work discipline show varying results depending on the organizational context and individual characteristics. This study underlines the importance of a holistic and integrated human resource management approach to optimize employee performance and productivity. Practical implications and suggestions for further research are also discussed.

DEFAULT IN THE SALE AND PURCHASE AGREEMENT OF A SHOPHOUSE IN NON-CASH AND ITS CONSEQUENCES ON HEIRS

Panji Maulana, Muhammad Insa Ansari, Teuku Saiful
Abstract: In binding the sale and purchase agreement between two parties must be carried out and obeyed in accordance with Article 1338 paragraph (1) of the Civil Code states that an agreement made legally will bind the parties as… binding as the law and become law for them. The agreed agreement will give birth to obligations that must be carried out by the parties, if not carried out, there will be default due to breach of the agreed agreement. As happened between Baniyamin as the buyer and the late Muhammad Husen as the seller in the binding of the shophouse sale and purchase agreement, there was a default due to the seller not delivering the object of sale and purchase, the buyer had fully paid the price of the shophouse but did not get his rights so that the buyer was disadvantaged in the sale and purchase agreement. The results showed that the buyer made several efforts to obtain his compensation rights for defaults made by the heirs starting from family settlements, giving warning letters twice but there was still no response, and filing a default lawsuit to the Court. The heirs' responsibility for the testator's debt initially planned to pay Rp. 50,000,000. This amount is insufficient from the total loss suffered by the buyer, so that at the time of mediation in the Court the buyer gave the option to the heirs to be able to make payments in stages with a minimum of paying half of the total loss suffered, but the heirs were not able to do so.

Pengaruh Lingkungan Kerja Non Fisik, Kompensasi, Beban Kerja terhadap Turnover Intention Gen Z

Izza Haniyah, Anwar Azazi, Dody Pratama Marumpe, Ilzar Daud, Efa Irdhayanti
Abstract: The participation of Generation Z in the contemporary labor market serves as a key catalyst in driving technological adoption, organizational innovation, and changes in work culture. However, the high turnover intention… among this generation indicates instability in employee retention, which can impact operational efficiency and continuity, particularly in the service sector. This study aims to empirically examine the influence of Non-Physical Work Environment, Compensation, and Workload on Turnover Intention among Generation Z workers in the Coffee Shop industry in Pontianak City, with Job Satisfaction as a mediating variable. A quantitative approach was employed in this study, with data collected through an online questionnaire using a five-point Likert scale. A total of 200 respondents aged 18–27 years were selected using purposive sampling based on relevant criteria. Data were analyzed using Structural Equation Modeling with the Partial Least Squares (SEM-PLS) approach via the SmartPLS 4 software. The analysis results show that the Non-Physical Work Environment has a significant negative effect on Turnover Intention, while Compensation has a negative but not significant effect. Workload has a significant positive effect on Turnover Intention. Furthermore, the Non-Physical Work Environment and Compensation have significant positive effects on Job Satisfaction, while the effect of Workload is not significant. Job Satisfaction is proven to act as a significant mediator in the relationship between the Non-Physical Work Environment and Compensation on Turnover Intention, but it does not mediate the relationship between Workload and Turnover Intention. These findings emphasize the urgency of formulating managerial strategies focused on improving the quality of the work environment and implementing adaptive compensation policies, in order to sustainably reduce turnover rates among Generation Z workers.
