Corporate Guarantee Legal Certainty Provided Without Shareholder Approval

Dianrachma, Mitari, Sugiyono, Heru, Sakti, Muthia
Abstract: The agreement providing a corporate guarantee does not provide a limit on the nominal amount that will be guaranteed by the corporate guaranteed provider because the corporate guarantee provider will guarantee the entire… debt including interest, fines, fees and other amounts of money that must be paid. In Indonesian limited liability company law, directors are required to seek shareholder approval in the case of pledging more than fifty percent of the company's assets, but in practice, approval from shareholders is not always required to provide a corporate guarantee. Especially in the case of corporate guarantees known as limited corporate guarantees, where the guarantee value does not exceed fifty percent of the Company's total assets. The aim of this research is to analyze the legal certainty of providing corporate guarantees without shareholder approval for credit applications whose value is less than fifty percent of the Company's assets. This type of research is normative juridical, namely a type of research with a conceptual approach. This research has the result that a corporate guaranteed agreement to guarantee the value of a credit facility whose value is not more than 50% of the company's assets provided without shareholder approval does not provide legal certainty.

Enhancing Micro, Small, And Medium-Sized Businesses Efficiency with Financial Literacy

Ma'sumah, Siti, Hamidi, Luthfi, Puspitarini, Ida
Abstract: Micro, small, and medium-sized businesses (MSMEs) play a big part in the economy, particularly in village economies. This is a result of the majority of rural firms still falling into the MSME category. Up until now, financial… ancial reports from MSMEs in rural areas have been infrequent. This is a result of MSME actors' ignorance regarding the preparation of financial reports. Low financial understanding translates into a low ability to produce financial reports. The MSME participants in Cilacap Regency's Sikanco Village, Nusawungu District, have not yet completed their financial reports for their companies. This is a result of their inexperience with financial report writing. Thus, it is impossible to accurately gauge the financial performance of MSMEs. As a result, help is required with both creating financial reports and raising awareness of financial literacy. This program helps with financial report preparation and raises awareness of financial literacy through the use of the Participatory Action Research (PAR) approach. MSME players came to the realization that financial report preparation is crucial to their firm after receiving support with it. Owners of MSME businesses become conscious of both their personal and company assets. As a result, helping to prepare MSME financial reports is crucial and beneficial for MSME participants. They make an effort to keep track of transactions and financial reports for their company, and the financial reports that have been generated are easily understandable. Residents developed an interest in and an understanding of the significance of financial reporting in order to mitigate the risk of business losses following their education. Additionally, MSME partners are growing increasingly interested in effectively managing family finances in order to improve their welfare since, through keeping track of household spending, they can identify areas where they can save more money and invest the proceeds.

Land Profit Sharing For Increasing Productivity

Ma'sumah, Siti, Luthfi Hamidi, Ibni Trisal Adam
Abstract: Indonesia is known for its rich agriculture, and rice is the staple food of the Indonesian people. The production of rice comes from rice fields, which are often managed by their owners or tenant farmers. However, not all… l rice field owners can efficiently manage their resources, which is why they can involve rice cultivators to help them out. The relationship between the owner of the rice fields and the tenant farmers is divided into two types of cooperation: maro and mertelu. Additionally, this type of cooperation can also be carried out in dry land areas, such as coconut plantations, coffee plantations, and more. This study focuses on the actors involved in maro and mertelu agreements in Banyumas Regency, Cilacap Regency, Kebumen Regency, Banjarnegara Regency, and Purbalingga Regency. The population size of this study is unknown, but based on calculations, a minimum sample size of 97 respondents is required. The criterion for selecting respondents is that they have entered into a maro or mertelu agreement and reside in one of the aforementioned regencies. The findings of the study indicate that individuals who have entered into maro or mertelu agreements do so for a variety of reasons. These reasons include supplementing their income to meet basic and other needs, ensuring they have a job and are not unemployed, and following the orders of the landowner. Some individuals also participate in these agreements because they are unable to purchase their own rice fields and want to work in the industry, while others do so to help those in need.

Tinjauan Yuridis Pertimbangan Hakim Dalam Pemberian Dispensasi Kawin Pasca Perubahan Batas Usia Minimum Perkawinan (Studi Penetapan Pengadilan Agama Serang Nomor 2006/Pdt.P/2024/Pa.Srg)

Dela Marsela, Sulkiah Hendrawati, Wahyudi
Abstract: Perkawinan anak masih menjadi persoalan hukum di Indonesia meskipun batas usia minimum perkawinan telah dinaikkan menjadi 19 tahun melalui Undang-Undang Nomor 16 Tahun 2019. Child marriage remains a legal issue in Indonesia even though the minimum age for marriage has been raised to 19 years through Law Number 16 of 2019. This increase in age has actually increased applications for marriage dispensation to the Religious Courts, raising questions regarding the conformity of granted dispensations with applicable regulations and the judge's basis for consideration in granting them. This study aims to analyze the conformity of granting marriage dispensation after the change in the minimum age limit for marriage based on Law Number 16 of 2019 and Supreme Court Regulation (PERMA) Number 5 of 2019, as well as to analyze the judge's basis for consideration in Decree Number 2006/Pdt.P/2024/PA.Srg based on PERMA Number 5 of 2019. This study uses a normative legal research method with a statutory, case, and conceptual approach. Primary legal materials, including Decree Number 2006/Pdt.P/2024/PA.Srg and related regulations, were analyzed descriptively and qualitatively. The research results show that the granting of marriage dispensation is formally and procedurally in conformity with Law Number 16 of 2019 and PERMA Number 5 of 2019, as the judge followed all required procedural steps. However, from a substantive standpoint, the reasoning concerning acts deviating from Islamic teachings is general in nature, so the "very urgent reason" standard tends to be applied loosely. The judge's basis for consideration consists of formal elements, namely authority and completeness of administrative requirements, and material elements, namely the fact of the romantic relationship between the prospective spouses and the application of the fiqh principle of dar'u al-mafasid muqaddamun ala jalbi al-mashalih, which, when reviewed through Marriage Theory, has addressed some aspects of the prospective spouses' readiness but has not been comprehensive regarding psychological readiness.

A MODEL OF CROSS-BORDER UNIVERSITY COLLABORATION IN THE DISTRIBUTION OF HUMANITARIAN AID TO FLOOD VICTIMS IN KETAMBE SUBDISTRICT (SOUTHEAST ACEH)

Assauwab, Muhammad Husaini, Kartono, Kartono, Ramud, Anuar, Sukriadi, Sukriadi, Alsi, Ilham, Apandi, Irfan, Marzuki, Mohd, Harith, Mohd
Abstract: The flood disaster that occurred in Ketambe District, Southeast Aceh Regency, at the end of 2025 caused significant impacts on local communities, including damage to housing, disruption of economic activities, and increased… sed demand for basic necessities. These conditions required a rapid, targeted, and well-coordinated humanitarian response. This community service program aimed to provide clothing and food assistance to flood victims while developing a cross-border university collaboration model for disaster response. The program was implemented through a partnership involving Universitas Gunung Leuser (UGL), Universiti Poly-Tech Malaysia (UPTM), and Insan Cakna. The implementation stages included needs assessment, institutional coordination, aid procurement, aid distribution, and program evaluation. UGL was responsible for needs assessment, local coordination, and aid distribution, while UPTM served as the primary donor providing financial assistance, clothing, and food supplies. Insan Cakna acted as the liaison and coordination facilitator between both institutions. The results demonstrated that the collaboration model improved the effectiveness and accuracy of aid distribution while strengthening institutional synergy in disaster response efforts. Beyond providing direct benefits to affected communities, the program generated a cross-border university collaboration model that can be replicated in future humanitarian and disaster management initiatives. The findings highlight that the success of humanitarian programs depends not only on the availability of aid but also on effective coordination, clear division of responsibilities, and sustainable institutional partnerships.

THE EFFECT OF HEALTH EDUCATION USING THE DEMONSTRATION METHOD ON HANDWASHING WITH SOAP (HWS) SKILLS AMONG CHILDREN

Pasaribu, Meilinda Handayani
Abstract: Handwashing with soap is one of the most effective public health measures for preventing gastrointestinal and respiratory infections among children. However, despite ongoing health education efforts, many children still… do not perform proper handwashing techniques. Interactive educational approaches, such as demonstration methods combined with songs, may enhance children's practical skills more effectively than conventional instruction. This study aimed to determine the effect of health education using a demonstration method on handwashing with soap skills among children in the BTN AL community, Entrop Subdistrict, South Jayapura District. A quantitative study with a one-group pretest-posttest pre-experimental design was conducted involving 20 child participants selected through total sampling. The intervention consisted of a live demonstration of the WHO six-step handwashing technique accompanied by a modified version of the children's song Naik Becak. Participants' handwashing skills were assessed before and after the intervention using the WHO Standard Hand Hygiene Observation Checklist. Data were analyzed using the Wilcoxon Signed-Rank Test. The findings demonstrated a significant improvement in children's handwashing skills following the intervention. Before receiving health education, most participants were unable to perform the recommended handwashing procedure correctly. After the intervention, 18 participants (90%) successfully demonstrated all six handwashing steps independently, while only two participants (10%) still required assistance. Statistical analysis showed a significant difference between pretest and posttest scores (p < 0.001). The study concludes that health education delivered through a demonstration method combined with a modified children's song effectively improves handwashing with soap skills among children. This approach may serve as an innovative and engaging strategy for promoting healthy hygiene behaviors in early childhood.
