Legal Review of Local Government Institutions in Papua under Government Regulation No. 106/2021

Abstract: The Province of Papua holds a special constitutional status under Law No. 2 of 2021, implemented through Government Regulation (PP) No. 106 of 2021, which assigns 23 governmental functions to regional authorities. The regulation… gulation embodies asymmetric decentralization intended to protect the rights of Indigenous Papuans (OAP) and address local needs. However, it raises legal concerns regarding ambiguous authority distribution between central, provincial, and municipal levels, as well as the unclear operational role of the Papuan People’s Assembly (MRP). The main research problem is whether PP No. 106/2021 provides a coherent and constitutionally consistent governance framework. This study applies doctrinal legal research using normative-analytical methods, including statutory interpretation, constitutional tests, and comparative perspectives. The findings indicate weak accountability mechanisms in managing Special Autonomy Funds, limited integration of customary law, and institutional fragility in newly established bodies such as BP-DOP and UPAP. The study concludes that PP No. 106/2021 does not fully align with the constitutional principles of legal certainty and decentralization. It recommends substantial revisions, strengthening MRP’s legal status, formal recognition of customary law through Perdasus, and an institutional blueprint with clear performance indicators to ensure effective, inclusive, and adaptive governance in Papua

Analysis of the Performance of Regional Government Treasurers in Compiling Reports and Accountability

Abstract: This study aims to analyze the role of local government treasurers in regional financial management, especially in terms of administration and preparation of accountability reports. Based on the importance of accountability… ity and transparency in public financial management, treasurers play a key role in ensuring that regional budget management runs well. This study uses a qualitative method with a literature study approach . review ), where data were obtained from books, journals, laws and regulations, and regional financial reports. The analysis was conducted by exploring various concepts regarding the types of treasurers, their duties and authorities, and the challenges faced in the process of preparing regional financial accountability reports. The results of the study indicate that there are three types of regional government treasurers, namely expenditure treasurers, revenue treasurers, and goods treasurers, each of which has its own duties and roles in managing regional finances. The treasurer's duties include recording, reporting, and accountability for budget use, with great authority in managing regional funds. However, significant challenges are faced in the administration process , such as the complexity of the accounting system and limited competent human resources. In conclusion, to improve the quality of regional financial reports, improvements are needed in the financial information system, increased treasurer competence, and better coordination between treasurers and related agencies. Overview of the Medical Waste Management System by Health Human Resources (SDK) at the Putri Ayu Public Health Center, Jambi City in 2024

Abstract: According to the Jambi City Health Service Profile in 2021-2022, Putri Ayu Health Center is one of the inpatient health centers in Jambi City which is also acontributes the largest amount of medical waste with the amount… of waste is 615 kg out of a total of 7804.1 kg of medical waste from health centers in Jambi City, so it has the potential to spread disease if medical waste is not managed properly. This research uses qualitative research methods with a descriptive approach. Data was obtained from 8 informants by conducting in-depth interviews and observations in May 2023 - April 2024 using qualitative research data analysis software. In the input aspect (1) Human Resources in the quantity aspect are sufficient, while the qualifications are not appropriate because they come from general administration. (2) Facilities and infrastructure are not sufficient and if there is damage, goods will be procured and reported to envinronmental health authority. Meanwhile, in the process aspect (3) Sorting is carried out by each waste producing poly unit by labeling the type of waste, date and poly, (4) The container used at the Putri Ayu Public Health Center meets the standards of Minister of Health Regulation Number 18 of 2020 (5) Transportation is carried out more than once every 2 days by PT Anggrek (6). Storage is carried out at TPS with a time span of 2-3 days at the latest. There are still input aspects that do not comply with standards (in the case of this research, namely the quality of human resources) causing disruption to process aspects, such as less than optimal management performance in managing medical waste in the container, transport and storage processes.  

Peran Pajak Bumi Dan Bangunan Perdesaan Dan Perkotaan Dalam Optimalisasi Pendapatan Asli Daerah Di Kabupaten Trenggalek

Abstract: Rural and Urban Land and Building Tax or what can be called PBB-P2 is one of the revenues included in Regional Original Income (PAD). With the existence of Law Number 23 of 2014 which is an amendment to Law Number 32 of… 2004 concerning Regional Government, and Law Number 33 of 2004 concerning Financial Balance between the Central Government and Regional Government which will give authority to the Government Regions to PBB-P2 areas in order to carry out government functions and increase regional income sources. The research method used is descriptive quantitative using several data obtained from research conducted by the Central Statistics Agency from 2017 to 2021. Based on the results of this research, it shows that the level of PBB-P2 effectiveness in Trenggalek Regency is classified as very effective. In contrast to the level of contribution of Rural and Urban Land and Building Tax to PAD, it is actually still not optimal. With this research, it is hoped that Trenggalek Regency can create new strategies and treatments to improve the system for managing Rural and Urban Land and Building Tax revenues in the context of optimizing Original Regional Income in Trenggalek Regency.

MEANINGFUL PUBLIC PARTICIPATION AS THE ESSENCE OF CONSTITUTIONALISM IN LAW MAKING

Abstract: Discourse on constitutionalism often emphasizes the existence of a written constitution as the foundation of democratic governance. Yet, constitutionalism is not merely about the text but it is about the lived practices… that give substance to constitutional ideals. This article interrogates the extent to which participation moves beyond symbolic consultation to become a substantive mechanism that embodies constitutionalism in practice. The central research question is how can meaningful public participation be conceptualized and operationalized as the essence of constitutionalism in legislative processes?  It examines constitutional provisions, statutory frameworks, and judicial interpretations in selected jurisdictions. The analysis is enriched by theoretical frameworks of deliberative democracy and participatory constitutionalism, which highlight the normative value of inclusivity, transparency, and accountability in law making. The article concludes that embedding meaningful public participation transforms law-making from a formal exercise of authority into a constitutional practice that legitimizes governance, strengthens democracy.  

THE AUTHORITY OF A NOTARIAL DEED COPY THAT UNDERTAKES CORRECTIONS DUE TO WRITING AND/OR TYPING ERRORS

Abstract: The ambiguity of the norms in Article 51 of the Law raises issues regarding the validity of copies of corrected deeds and the liability of Notaries towards the parties involved. This study aims to analyze the legal status… s of the corrected deed copies and the forms of Notaries' responsibility for errors that occur. The research method used is normative juridical legal research with legislative and conceptual approaches, through descriptive qualitative analysis of primary and secondary legal materials. Research findings indicate that corrections to copies of deeds remain valid and equivalent to the deed minutes as long as the errors are administrative in nature and the corrections are made in accordance with regulations, so they do not alter the substance of the deed. However, if corrections are made not in accordance with the UUJN procedures or result in substantial differences with the minutes, then the copy of the deed may be downgraded to a private deed and categorized as a legally defective deed. Notaries are liable in civil, administrative, criminal, and ethical terms, because such negligence constitutes an unlawful act under the concept of liability. In conclusion, corrections to deed copies remain valid as long as they do not change the substance and are carried out according to procedure, while Notaries are obliged to bear legal responsibility for any typing or writing errors arising from their negligence.

Abstract: Payment ID merupakan bagian integral dari Blueprint Sistem Pembayaran Indonesia (BSPI) 2030 yang dirancang sebagai kode unik sembilan karakter berupa kombinasi huruf dan angka. Sistem ini memiliki tiga fungsi utama: identifikasi… tifikasi profil pelaku sistem pembayaran secara spesifik, otentikasi data transaksi, dan konektivitas data antara individu dan catatan transaksi secara rinci. Implementasi sistem serupa di negara lain telah menunjukkan dampak ekonomi positif yang substansial. India, melalui kombinasi UPI dan Aadhaar, berhasil menghemat lebih dari $9 miliar dari eliminasi fraud dalam program bantuan sosial. Sistem UPI India kini menangani 18 miliar transaksi bulanan dengan nilai mencapai Rs 24 lakh crore, menguasai 85% ekosistem pembayaran digital nasional. seperti PayNow di Singapura, membuktikan pentingnya landasan hukum yang jelas. PayNow, yang diatur dalam Payment Services Act 2019 dan diawasi oleh Monetary Authority of Singapore (MAS), mengintegrasikan sistem perbankan dan dompet digital melalui satu ID berbasis nomor ponsel atau NRIC, dengan dukungan Personal Data Protection Act (PDPA) 2012 yang kuat. Keberhasilan ini didorong oleh regulasi yang komprehensif, standar keamanan yang ketat, serta pengawasan yang terintegrasi. Regulasi ini menjadikan PayNow sebagai sistem pembayaran instan berbasis identitas tunggal yang dapat dipercaya, dengan proteksi hukum dan keamanan yang terjamin. Sistem ini menghubungkan nomor ponsel, NRIC, atau nomor bisnis dengan rekening bank secara aman, memungkinkan transaksi real-time dan interoperabilitas lintas platform. Dengan demikian, Indonesia perlu memperkuat landasan hukumnya dengan membentuk kerangka hukum nasional yang komprehensif, meliputi aspek perlindungan data pribadi, interoperabilitas, tata kelola teknologi, mekanisme pengawasan, dan pemberdayaan pengguna, agar implementasi Payment ID dapat terlaksana secara aman, inklusif, dan berkelanjutan

Tinjauan Hukum Administrasi Negara Terhadap Efektivitas Pemungutan Retribusi Sampah Berdasarkan Perda Bangkalan No. 1 Tahun 2024

Abstract: AbstrakPenelitian ini bertujuan mengkaji efektivitas pemungutan retribusi pelayanan persampahan di Kabupaten Bangkalan pasca berlakunya Peraturan Daerah Kabupaten Bangkalan Nomor 1 Tahun 2024 tentang Pajak Daerah dan Retribusi… ribusi Daerah. Melalui pendekatan Hukum Administrasi Negara, kajian ini membedah keabsahan wewenang, instrumen yuridis, dan hambatan operasional Dinas Lingkungan Hidup Kabupaten Bangkalan. Analisis dilakukan dengan menerapkan teori kewenangan Philipus M. Hadjon, teori instrumen pemerintahan Ridwan HR, serta teori efektivitas hukum Soerjono Soekanto. Hasil penelitian mengungkapkan bahwa rencana penerapan retribusi sampah bagi dapur Program Makan Bergizi Gratis sebesar dua ratus ribu rupiah per bulan berdasarkan Peraturan Daerah Nomor 3 Tahun 2024 dan Peraturan Bupati Nomor 9 Tahun 2025 belum berjalan efektif. Tingkat kepatuhan wajib retribusi sangat rendah karena hanya sekitar dua puluh pelaksana yang melakukan pembayaran. Penyebab utama meliputi ketidakjelasan skema pelayanan akibat tarif yang tidak mencakup biaya pengangkutan sampah, kelumpuhan infrastruktur di Tempat Pemrosesan Akhir Buluh, dan lemahnya penegakan sanksi administratif oleh aparat pemungut. Situasi ini memicu tindakan kedinasan non-prosedural serta konflik sosial-ekologis dengan masyarakat desa setempat. Guna menyelesaikan permasalahan tersebut, diperlukan klarifikasi skema pelayanan yang mencakup seluruh komponen biaya, rehabilitasi infrastruktur pemrosesan sampah, serta penguatan penegakan sanksi administratif untuk meningkatkan kepatuhan dan efektivitas pemungutan retribusi. AbstractThis study aims to examine the effectiveness of waste service retribution collection in Bangkalan Regency following the enactment of Bangkalan Regency Regional Regulation Number 1 of 2024 concerning Regional Taxes and Retributions. Using an Administrative Law approach, this research analyzes the legitimacy of authority, juridical instruments, and operational obstacles faced by the Environmental Agency of Bangkalan Regency. The analysis applies Philipus M. Hadjon’s theory of authority, Ridwan HR’s theory of government instruments, and Soerjono Soekanto’s theory of legal effectiveness. The findings reveal that the planned implementation of a waste retribution fee of two hundred thousand rupiah per month for kitchens under the Free Nutritious Meals Program (Program Makan Bergizi Gratis), based on Regional Regulation Number 3 of 2024 and Regent Regulation Number 9 of 2025, has not been effective. The level of compliance among retribution payers remains very low, with only approximately twenty operators making payments. The main causes include unclear service schemes due to tariffs that do not cover waste transportation costs, the dysfunction of infrastructure at the Buluh Final Processing Site (Tempat Pemrosesan Akhir Buluh), and weak enforcement of administrative sanctions by collection officers. This situation has triggered non-procedural administrative actions and socio-ecological conflicts with local village communities. To address these issues, it is necessary to clarify the service scheme to include all cost components, rehabilitate waste processing infrastructure, and strengthen the enforcement of administrative sanctions in order to improve compliance and the overall effectiveness of retribution collection. Legal Certainty Regarding Sharia Banking Dispute Resolution In The Context Of Constitutional Court Decision Number 93/PUU/X/2012

The research method used is descriptive normative. Research results explain that the Decision of the Constitutional Court Number 93/PUU/X/2012 confirms certainty of law by deleting dualism of authority justice, making the Religious Court as an institution the sole authority to finish Islamic banking through track litigation. Thus, it can be concluded that this decision cancels the explanation of Article 55 paragraph (2) of the Sharia Banking Law, eliminates forum selection to the District Court; however, it still allows non-litigation settlement, such as Sharia arbitration. The settlement process of disputes in Islamic banking, as arranged in Article 55 paragraph (1), (2), and (3) of the Sharia Banking Law, has given duties and authorities to courts in the neighborhood religious courts.

Sharia Insurance Disputes Through Sharia Arbitration: A Legal Discourse

Abstract: Sharia insurance in Indonesia is growing, because along with the increasingly complex disputes between parties, which cannot be avoided between Islamic insurance companies and policyholders, this is even though both of them… hem help and protect each other. The problem is regarding the legal basis for sharia insurance dispute resolution which is still scattered in several laws and regulations. This has become a discourse and issue of legal norms for sharia arbitration as an option for sharia insurance dispute resolution, and so far the resolution of sharia insurance disputes through sharia arbitration is regulated by Supreme Court Regulation Number 14 of 2016. The research method used is descriptive normative. The research method used is descriptive normative by analyzing regulations laws governing sharia dispute resolution. The results of this study explain that state policy in managing sharia insurance disputes is still a discourse, so that constitutional authority still uses Article 58 of Law no. 48 of 2009 concerning Judicial Power. Therefore, it is necessary to amend Law No. 30 of 1999, specifically regarding the article regarding the District Court, which must be supplemented by the Religious Courts and procedures for resolving disputes through sharia arbitration.
